PROVISIONS IN FAVOUR OF WOMEN - BOON OR SIN?
WHERE ARE WE HEADING??

Provisions for Maintenance of wives, domestic violence, etc were made in order to air the greivances of women who were neglected, oppressed & ignored factually. In that sense adopting liberal approach was understandable to afford justice to the victim. It was meant to help them.

However, sadly, although, it pains me to say this, [ cause I was myself a staunch feminist some decades ago], over the years these provisions only seem to be used as a tool of extortion by selfish, greedy women for whom marriage is utilising husband's resources. Their thirst for money just doesn't get quenched with however much they get. There are examples where despite an irretreivable breakdown of marriage, they keep pouring applications, despite already getting huge amounts of Rupees; while ironically the genuine destitutes & oppressed don't get anything. In short it is only the misuse that surfaces!

And the misuse is so alarming & rampant, that after having been paid huge amounts of money... in guise of maintenance *under various heads--* which is apparently on record, educated, well qualified women have the audacity to file applications before various authorities claiming that their children are starving!! ??? And this despite *earning pretty well!* which is of course not revealed.

So the questions that arise in mind are these :
1 Is this glaring fact being noticed by anyone?
2 If yes, do others feel just the same and replicate my thoughts??
3.Should we belonging to the noble profession not dissuade such tendency, at least visavis our own clients?
4. Are we all justified in turning a blind eye to the situation?
5. I ask myself if i can keep quiet with my conscience suppressed just because I grt fees? Am I not duty bound to read the facts and point out the wrong? And am I not to refrain from accepting briefs of apparent misuse of law ! Have moral values depleted so much?

Although maintenance can be claimed at different forums, it is highly unequitable to compel husband to pay in every proceeding. Hence wife is dutibound to disclose the maintenance that may have been already granted to her and accordingly adjusted..
