The Jharkhand High Court has upheld the dismissal of a husband's divorce petition, holding that a wife's mere wish that her husband live as a Gharjamai (son-in-law residing with the wife's family) does not amount to cruelty under Section 13(1)(ia) of the Hindu Marriage Act, 1955. The Court observed that while agreeing to live as a Gharjamai is the groom's personal choice, a simple request or wish by the wife cannot be treated as matrimonial cruelty in the absence of any compulsion or coercion. The Court further held that a wife's visits to her parental home are a normal and legitimate aspect of married life and cannot, by themselves, constitute cruelty warranting dissolution of marriage.
