A recent observation of the Bombay High Court has brought an important aspect of matrimonial financial responsibility into focus.

When both spouses are earning, financial responsibility towards the household and children cannot, in every circumstance, be treated as the sole responsibility of one spouse.

The Court observed that if both husband and wife earn and choose to maintain a particular lifestyle for themselves or provide the best education to their child, both are expected to contribute towards those expenses.

⚖️ From a Lawyer’s Perspective

This is not about “husband vs. wife.”
It is about equality, fairness and shared responsibility within a modern marriage.

Marriage is a partnership and when both partners have an income, the financial responsibilities of that partnership may also need to be shared, depending upon the facts and circumstances of each case.

At the same time, an important distinction must be remembered:

A wife earning an income does not automatically mean that she is disentitled to maintenance. Maintenance is determined on the basis of several factors, including the respective incomes, needs, standard of living, financial obligations and circumstances of the parties.

The real message is therefore not “women should pay.”

It is: EQUALITY MUST COME WITH SHARED RESPONSIBILITY

A healthy marriage is not about keeping a scorecard of who paid what.

Helping a friend or relative financially is a kind gesture, but when repayment becomes an issue, many people realise they have little or no documentary proof to support their claim.

Here are a few legal precautions everyone should take before lending money:

✅ Always transfer money through a bank.
Avoid cash transactions wherever possible. Bank records create an important trail of evidence.

✅ Put the terms in writing.
Even a simple written agreement mentioning the amount, date, repayment timeline, and signatures of both parties can make a significant difference.

✅ Preserve all communications.
WhatsApp messages, emails, SMS, bank statements, receipts, and any acknowledgment of the debt may become valuable evidence if a dispute arises.

✅ Do not rely solely on verbal promises.
