DID YOU KNOW???

If a case is pending for an unreasonable period, the High Court can step in and order the lower court to decide the matter within a fixed time.

🔹 This power flows mainly from Article 227 of the Constitution of India, under which the High Court supervises subordinate courts.

🔹 In appropriate cases, directions may also be issued under Article 226 to ensure timely justice.

⏳ Justice delayed is justice denied and constitutional remedies exist to prevent unnecessary delay.

👉 Always consult a legal professional to assess whether your case qualifies for such relief.

💔 Mutual Divorce and Alimony: A Clear Legal Perspective

Mutual consent divorce is governed by Section 13B of the Hindu Marriage Act, 1955, where both spouses agree to dissolve the marriage amicably, without levelling allegations against each other. It is a civilised legal route to separation and often avoids long, bitter courtroom battles.

✅ Is Alimony or Consideration Valid in Mutual Divorce?

YES, alimony or financial consideration is absolutely valid and legal in a mutual divorce.

In fact, Section 13B(2) mandates that the terms of settlement, including maintenance (alimony), child custody, and division of assets, must be mutually agreed upon and clearly mentioned in the joint petition filed before the court.

Courts across India have consistently upheld such financial arrangements as valid and enforceable, provided both parties have given free and informed consent.

📌 Judicial Precedents:

1. Sureshta Devi v. Om Prakash, (1991) 2 SCC 25

The Supreme Court clarified that mutual consent must continue till the decree is passed and both parties should freely agree on all material terms, including maintenance and custody.

2. Hitesh Bhatnagar v. Deepa Bhatnagar, (2011) 5 SCC 234

Reinforced that mutual consent implies consent on all aspects – including alimony and financial arrangements – which the court can record as binding.

3. Kanchan v. Kamalendra, AIR 1992 MP 150

Held that payment of maintenance or a one-time settlement under mutual divorce is a legal and valid consideration, and not against public policy.

This ruling reinforces the principle that alimony must be realistic and fair, ensuring post-divorce financial stability, especially for non-earning or lesser-earning spouses.

💰 Types of Alimony in Mutual Divorce:

Lump Sum Settlement – One-time payment to the wife or husband.

Monthly Maintenance – Regular financial support if agreed.

Waiver of Maintenance – If both parties explicitly agree to forego any claims.

These terms are typically recorded in a Mutual Divorce Settlement Agreement, which becomes an integral part of the court’s final decree.

⚖️👇🏼 Key Points to Remember:

👉🏼Alimony is not illegal consideration, but a recognized component of a mutual divorce settlement.

👉🏼Courts ensure that both parties give free and informed consent to the settlement.

👉🏼Maintenance can be waived, but this must be expressly stated and voluntarily agreed.

✍️ Conclusion:

Alimony or financial consideration in a mutual divorce is valid, legal, and often necessary to ensure fairness—especially when one party is financially dependent. Indian courts, including the Supreme Court, continue to uphold such arrangements so long as they are fair, transparent, and mutually agreed.

💡🫰🏼 Legal Tip: Always consult a qualified divorce lawyer to draft a clear and enforceable settlement agreement that protects both parties' rights and avoids future disputes.
