Delhi High Court Orders Regular Trainings For Officers Holding 'Summary Security Force Court' Proceedings Under BSF Act

The Delhi High Court has ordered that mandatory regular trainings be provided to Officers holding the Summary Security Force Court (SSFC) proceedings under the Border Security Force (BSF) Act and Rules. A division bench comprising Justice Rekha Palli and Justice Shalinder Kaur observed that the Court was coming across a number of cases where the SSFC proceedings were being conducted in a lackadaisical and perfunctory manner by disregarding the rules and procedures.

“It is also being noticed that despite there being no urgency, SSFC proceedings are being conducted in almost every case as a matter of routine. The provisions providing for other kinds of Security Force Courts which lay down more elaborate procedure for trial are very rarely being resorted to,” the court said.

CCI must respect mediation process: Delhi High Court sets aside probe against JCB

The Delhi High Court recently set aside an inquiry initiated by the Competition Commission of India (CCI) against UK-based JCB and its Indian subsidiary over the alleged misuse of its dominant position [JCB India Limited and Anr v The Competition Commission of India and Anr]. A Division Bench of Justices Prathiba M Singh and Amit Sharma quashed the CCI proceedings and an order passed by the trial court issuing search warrants against JCB. The Court noted that the informant Bull Machine, an Indian company manufacturing tractors and tractor attachments, had withdrawn its complaint from the CCI after settling the matter with JCB.

SEBI orders probe against SME IPO merchant banker for alleged violations while managing issues: Report
Capital markets regulator Securities and Exchange Board of India (SEBI) is reportedly investigating Corporate Capital Ventures Limited. The Delhi-based merchant banker, which has managed some initial public offers (IPOs) of small and medium enterprises (SMEs), has come under the regulatory scanner for alleged violations of merchant banking regulations while managing public issues. According to a report by news website Moneycontrol, SEBI has issued a notice to the merchant banking entity and named the company's directors – Kulbhushan Parashar and Harpreet Kaur – along with a few other entities in the notice. The report added that the market watchdog's investigation was triggered after it received an anonymous complaint alleging that Kulbhushan Parashar, through his relatives, bought shares in companies before taking them public.

RBI draft framework mandates additional authentication for all digital payments

To enhance the security of digital payments, the Reserve Bank has issued a draft framework for alternative authentication mechanism for all digital payments, mandating an additional factor of authentication (AFA) for all digital payment transactions, except small value, contactless card payments for up to Rs 5,000 at point of sale terminals, e-mandates for recurring transactions, and small value digital payments through offline mode, among others. Additionally, the RBI draft says all digital payment transactions, other than card present transactions, have to ensure that one of the factors of authentication is dynamically created -- that is to say the authentication factor is generated after initiation of payment and is specific to the transaction and cannot be reused. Card present transactions are carried out physically.

Non-Signatories Bound By Arbitration Clause When Purchasing Property From Agreement Parties: Karnataka High Court
The Karnataka High Court bench of Justice Anu Sivaraman and Justice Anant Ramanath Hegde has held that a person who is not a party to the arbitration agreement but buys property from someone who is a party to the agreement is still bound by the arbitration clause that applies to their vendors. The High Court noted that the Constitution Bench of the Supreme Court decision in Cox and Kings Limited v. SAP India Private Limited and Another was primarily concerned with whether the phrase "claiming through or under" in Section 8 of the Arbitration Act includes the "Group of Companies" doctrine and whether this doctrine, as previously outlined in Chloro Controls India (P) Ltd. v. Severn Trent Water Purification Inc., constitutes valid law.
