Supreme Court Strengthens Citizens’ Rights in a Landmark Ruling ⚖️

The Supreme Court has declared that written grounds of arrest are mandatory in all arrest cases, and failure to provide them will render the arrest illegal.

This important safeguard under Article 22(1) now applies across all offences, including those under the Bharatiya Nyaya Sanhita (BNS). It ends the belief that such rights only exist under special laws like UAPA or PMLA.

In the case of Mihir Rajesh Shah vs State of Maharashtra, the Court also reaffirmed that withholding this information violates the fundamental rights protected under Article 21.

⚖️ RIGHTS OF AN ARRESTED PERSON — KNOW YOUR RIGHTS, KNOW YOUR POWER ⚖️
Most people are unaware of what they can legally do or demand if they’re ever arrested. But awareness is your first line of defense against injustice. 💡
Under Article 22(1) of the Indian Constitution, every person has the Right to Consult a Lawyer of their choice and get proper legal defense. No police officer or authority can deny this — it’s your fundamental right.
The new Bhartiya Nagarik Suraksha Sanhita (BNSS), 2023 also reinforces these protections:
🟢 Section 340 & Section 38 — allow every accused to meet and consult a lawyer during interrogation.
🟢 Section 47, 48 & 77 — make it mandatory for officers to clearly inform the reason for your arrest and show the warrant if required.
🟢 Section 78 — ensures that every arrested person is produced before a magistrate within 24 hours of arrest.
And yes — Article 22(2) of our Constitution backs this up by stating that no one can be detained beyond 24 hours without being produced before a magistrate.
💬 These rights exist to protect your freedom, ensure fair treatment, and prevent misuse of power. But they only help when you know them.
