⚖️ SUCCESSFULLY REPRESENTED THE COMPLAINANT

The Court allowed our application under Section 156(3) CrPC and directed the police to register an FIR and conduct a proper investigation.

The police had initially treated the matter as a civil dispute involving a monetary transaction. We argued that the allegations went much further and involved:

✅ Impersonation
✅ Misuse of identity documents
✅ Misuse of cheques
✅ Fraudulent inducement
✅ Threats to the complainant

The Court observed that bank and KYC records, company documents, cheque-book records, electronic evidence and disputed signatures required investigation by the police.

A monetary transaction cannot automatically be labelled a “civil dispute” when the allegations disclose elements of fraud, impersonation and forgery.

Most commercial disputes I see have nothing to do with bad intent, they arise from
• vague obligations
• poorly defined exit clauses
•weak enforcement mechanisms
