Burger King Corporation v. Anahita Irani

1989: Burger King USA registered it's tradename in India but didn't start operations.

1992: a local eatery run by started their business in the name of 'Burger King.

2008: Burger King started its operations in India to realise that Punes' eatery is using its name.

2009: Burger King USA filed a lawsuit for trademark infringement.

2014: This local eatery dropped the word 'King' from their name but they continued to fight the suit.

2024: Pune district court decided to declare and give back the name to Pune's burger king ne on the following grounds:

1. Prior use (Section 34 Trademarks Act, 1999) and
2. Honest and concurrent use (Section 12 Trademarks Act, 1999).

Burger King USA couldn't prove:
1. Likelihood of confusion (Section 29(2)(c) Trademarks Act, 1999)
2. Actual damage caused (Section 135 Trademarks Act, 1999).
