GST Department Cannot Harass Advocates for Client Information_Calcutta High Court

Facts of the Case:
Advocate Himangshu Kumar Ray approached the Calcutta High Court after the GST Department issued multiple notices to several advocates, asking them to provide details about their clients involved in alleged GST fraud cases.

These notices were issued after an earlier court order directing authorities to investigate fake writ petitions, which were believed to have caused a loss of GST revenue.

What the Court Said:
The court ruled that all communications between a lawyer and their client are confidential and protected under Section 126 of the Indian Evidence Act.

Unless the communication is meant to commit a crime or fraud, it cannot be disclosed without the client's consent.

The GST department had sent generic, templated notices without mentioning any specific case or client, which the court found to be legally baseless.

These notices were later withdrawn via email on 5th June 2023 after legal advice was taken.

Final Verdict:
The court made it clear that the GST Department cannot send repeated or blanket notices to advocates just to gather client information, as this violates the advocate-client privilege._
