One important lesson from my daily practice:

I recently dealt with a GST notice that seemed routine but nearly took an unexpected turn due to a single missing document.

- A GST notice.
- A confident founder.
- An auditor who believed everything was in order.
- A missing document that could have completely changed the course of the proceedings.

This situation highlights that it's not just about tax; it illustrates how white-collar investigations unfold. The same facts can be interpreted differently by an auditor and an advocate. A single contemporaneous document can become the strongest piece of evidence in your defense.

This experience reinforced a key lesson in white-collar practice: when an investigation begins, the law doesn't read intentions; it reads your file.

A founder walked into my office carrying a file. He placed it on my table and said, Founder: Sir, I received this notice from the GST Department yesterday.

New profile pic, mandatory court gown edition! 😎
It is not only the robe or gown that we wear which defines us, but the great responsibility it bestows upon us for the upliftment of society through better prudence and justice.

Because in these times, even Facebook needs to see that advocates are still working for the nation’s conscience... and occasionally updating their DP as per the unwritten rules of the Bar! 😂

Disturbing Trend in GST:

Tax Officer Files FIR Against Advocate for Professional Advice.

A tax advocate filed GST first appeals by utilizing the Electronic Credit Ledger for pre-deposit — a practice supported by CBIC circular and judicial precedents (including Supreme Court).

The Appellate Authority dismissed the appeals on maintainability. Instead of proceeding with recovery, the jurisdictional Deputy Commissioner (GST) filed an FIR against both the assessee and the advocate, alleging conspiracy and evasion.
What followed was even more shocking Police filed the charge-sheet in just one day, and cognizance was taken immediately.

Fortunately, the matter reached the Hon’ble Allahabad High Court, which quashed the entire FIR, charge-sheet, and cognizance order against the advocate.

In a strongly worded judgment, the Division Bench observed that implicating an advocate for acts done in his professional capacity is perilous and strikes at the root of the legal profession and the citizen’s right to legal representation.

The Court even summoned the Deputy Commissioner, who could not provide any satisfactory explanation for naming the advocate in the FIR.

This case highlights a troubling misuse of statutory powers and the growing tendency to criminalize bona fide legal and interpretational issues under GST.

Advocates must be able to advise and represent clients without fear of becoming co-accused.
Kudos to the Allahabad High Court for standing up for the Bar and constitutional values.

Big Relief for Bank Account Holders: Landmark Judgment by Allahabad High Court

In a significant ruling with far-reaching implications for banking practices and customer rights, the Allahabad High Court (Lucknow Bench) has held that banks cannot arbitrarily freeze customer accounts on their own by merely invoking provisions of the Prevention of Money Laundering Act (PMLA), 2002, without any order from a competent authority.

Key Highlights of the Judgment

(Writ-C No. 1866 of 2026 - M/s S.A. Enterprises v. Reserve Bank of India & Ors.):

- Banks are not investigating agencies. They cannot unilaterally assume the role of investigators and freeze accounts based on internal suspicions or vague "suspicious transaction" claims without following due process.
- Arbitrary freezing of accounts violates the customer's legal and constitutional rights, including the right to livelihood and Article 21 of the Constitution of India.
- The Court strongly deprecated the practice of indiscriminate freezing of accounts, observing that it paralyses business operations, causes financial loss, and erodes trust in the banking system.
- The writ petition was allowed, directing the Indian Overseas Bank to de-freeze the petitioner's account.
- A compensation of ₹50,000 was imposed on the bank (payable within four weeks) for the arbitrary action.

This judgment reinforces the principle that banking operations must respect the rule of law and principles of natural justice. Banks can only freeze accounts in exceptional cases backed by:
- A specific order from a competent authority, or
- Exercise of lien under Section 171 of the Indian Contract Act, 1872 (in case of outstanding loans).

For Professionals, Businesses & Account Holders:

This ruling serves as an important safeguard against high-handed actions by banks and underscores the need for greater accountability in financial institutions.

The CBI has launched ABHAY, an AI-powered notice verification portal designed to help citizens identify fake CBI notices and stay protected from rising cyber frauds like “Digital Arrest” scams. In an era where cybercriminals use fear and technology to deceive people without even stepping out of their homes, ABHAY acts as a reliable platform for verifying the authenticity of notices issued in the name of CBI.

This initiative empowers citizens by providing a simple and secure way to check whether a notice is genuine or fraudulent. The portal is a much-needed step towards strengthening public awareness and combating online scams, impersonation calls, and fake legal threats. Citizens are advised to remain alert, avoid panic, and verify suspicious notices through the official ABHAY portal before taking any action.
