How to Read a Criminal Case File - A Step-by-Step Guide

Reading a criminal case file can be overwhelming, especially for interns or law students. Here's a simple, step-by-step guide to help you understand how to read a criminal case file effectively.

1. Cover Page / Index
Check the case number, names of parties, FIR number, and court name.
Note the advocate's name, police station, and date of filing.

2. FIR (First Information Report) – Section 154 CrPC
Understand who filed the complaint, the date/time of offence, and a brief of what happened.

3. Chargesheet / Final Report – Section 173 CrPC
Check what charges have been framed and which sections of IPC/BNS/other Acts are applied.

4. Case Diary / Investigation Papers
Details of the police investigation.
Statements recorded under Section 161 CrPC.

5. Statements under Section 164 CrPC
Voluntary statements before the magistrate (especially important in sexual offences).

6. Panchanama / Site Map / Seizure Memo
Look for documents showing seizure of evidence (weapon, clothing, etc.).

7. Medical Reports / Forensic Reports
MLC reports (Medico Legal Case), Post-Mortem Reports, DNA or FSL reports.

8. Witness List & Statements
Helps identify who will testify in court and what they will say.

9. Remand Papers / Bail Orders
Orders granting or rejecting police/judicial custody.
Check for any bail applications or orders.

10. Court Proceedings / Daily Orders
Record of what happens during each hearing (e.g., charge framed, witness examined).

11. Charge Framing
Under Section 228 CrPC (Sessions Court) or 240 CrPC (Magistrate Court).

12. Examination of Witnesses
Section 313 CrPC: Accused statement.
Section 311 CrPC: Recall of witnesses.

13. Final Arguments & Judgment
Summary of both sides' arguments and the court's judgment.

14. Appeal / Revision Documents (if any)
If the case has gone into appeal, those papers will also be part of the file.

Tips:
Read in chronological order.
Highlight important dates, sections, and contradictions in statements.
Use sticky notes or tabs to organize bulky files.
