⚖️ Who is really representing your Federal Court case?

A growing concern in Canadian immigration litigation is that many applicants challenge their visa refusals through agents, consultants, or middlemen without ever speaking directly to the lawyer handling their Federal Court case. In some situations, clients do not even know the name of the lawyer representing them.

Your lawyer owes duties to YOU — not to the middleman.

In this public-interest video, we show you how to identify the lawyer representing your Federal Court matter:

✅ Visit the Federal Court of Canada website
✅ Click on “Court Files”
✅ Search using your file number or party name
✅ Open the case details and click on “Parties”
✅ View the law firm and lawyer listed as counsel of record

Direct communication with your lawyer is essential. Your case strategy, evidence, and legal arguments should be discussed with the person who is actually appearing before the Court on your behalf.

The client’s best interests must always come first—not the interests of an agent, consultant, or intermediary.

This educational video is being released in both English and Punjabi to help members of the public better understand their rights and ensure they receive proper legal representation.

🚨 Biggest Mistake in Spousal Sponsorship Appeals (IAD) 🚨

The #1 reason spousal sponsorship appeals fail at the Immigration Appeal Division?
👉 A weak applicant testimony.

Here’s what usually happens ⬇️
When an outland spousal sponsorship is refused, it’s almost always after a failed interview at the Canadian High Commission — in India, that’s New Delhi.
Small inconsistencies. Wrong answers. Poor explanations.
Those interview notes become the foundation of the refusal.

Now comes the appeal.
Both the sponsor (appellant) and the spouse (applicant) get a second chance to testify before the IAD Member and Minister’s Counsel.

❌ Big mistake:
Clients don’t fix the applicant’s testimony.
They repeat the same errors — and the appeal fails.

✅ What we do differently at Fateh Law Corporation:
• We rebuild the applicant’s testimony from the ground up
• We explain how the “bad faith marriage” test is actually applied under the IRPA
• We prepare a detailed affidavit from India, covering the full development of the relationship
• We conduct in-person testimony preparation so there are no surprises
• We gather ground-level evidence from India, including affidavits and supporting documents

📍 Uniquely positioned in Chandigarh, India
For refusals from the New Delhi Visa Office, we specialize in IAD spousal sponsorship appeals.

Spousal Sponsorship Refused ❌
Reapply or Appeal? 🤔

This is one of the most common questions couples ask after a Family Class spousal sponsorship refusal.

👉 The answer? It depends entirely on the facts of your case.

📌 Our Case Timeline:
• Refusal: April 7, 2025
• IAD Hearing: November 7, 2025
• Passport Request: January 16, 2026

⏱️ Total time: ~9 months

📊 Compare this with current processing times for outland spousal sponsorships from India (outside Quebec) — approximately 14 months.

➡️ In this case, appealing to the Immigration Appeal Division (IAD) was faster and more effective than reapplying.

🔍 Why was the application refused?
The main issue was the applicant’s interview testimony.
We addressed this by:
✔️ Preparing strong testimony
✔️ Filing new corroborating evidence
✔️ Submitting Canadian affidavits
✔️ Explaining the cultural context and Indian legal background

🇮🇳 Being based in India gave us a critical advantage — we understood the cultural nuances and legal realities, and we successfully convinced the Minister’s Counsel and the IAD Member.

✅ Result:
The appeal was allowed on consent.
The refusal was overturned.
The couple can finally reunite in Canada 🇨🇦❤️

⚖️ Every refusal is different.
Some cases should be reapplied.
Others must be appealed.

📞 If your spousal sponsorship has been refused, speak to an experienced litigation lawyer before making the wrong move.

Spousal Sponsorship Appeal refused? Your case needs more than just a senior lawyer.

At the Immigration Appeal Division, experience alone is not enough.
You need a lawyer who understands culture, context, and law—especially when your case involves India.

Mr. Navratan Fateh brings over 12+ years of litigation experience before the Immigration Appeal Division and the Federal Court of Canada. He has also been a practicing Advocate in India since 2012. This rare combination of Canadian immigration law + Indian legal and cultural knowledge makes all the difference in sensitive spousal sponsorship appeals.

📍 Case Highlight
In a highly sensitive appeal argued on September 7, 2025, the refusal was based on an incorrect finding that the marriage was not bona fide under Regulation 4 of the IRPA. The case required deep cultural understanding, knowledge of Indian family structures, and religious marriage practices.

Mr. Fateh—who wrote his University of Toronto thesis on honour-based violence in Canada—was uniquely equipped to present this evidence.
We demonstrated that:
• The marriage was arranged with religious and cultural significance
• Only trusted family and friends knew of the relationship due to family sensitivities
• Both the sponsor and applicant gave credible, consistent testimony
• Cultural orthodoxy opposing the marriage was navigated with care and respect

⚖️ Result:
The appeal was allowed on consent.
On January 16, 2026, the applicant received a Passport Request and will soon reunite with their spouse in Canada 🇨🇦

Takeaway:
In spousal sponsorship appeals, you don’t just need a seasoned litigator—you need a lawyer with cultural sensitivity and knowledge of Indian laws.

A youthful mistake should not define a lifetime.

13 years ago, our client made a single error — a shoplifting incident in the United States in 2012 involving clothing items worth $196.
No violence. No repeat offences. Just a moment of misguided youthful excitement.

But that one mistake followed him for years.
His spousal visa to Canada was repeatedly refused, keeping him separated from his wife and questioning his admissibility again and again.

👉 We took his case head-on.

Before IRCC, we argued that the law is clear:
✔️ More than 10 years had elapsed
✔️ This fell squarely under deemed rehabilitation
✔️ He posed no danger to the Canadian public

We filed detailed Canadian affidavits, strong legal submissions, and relied on leading cases like Chirwa and Ribic.
Most importantly, our client was candid and honest, fully accepting responsibility and expressing genuine remorse.

🚨 A past mistake does not mean lifelong punishment.
People grow. People change. And Canadian immigration law recognizes that.

📩 January 20, 2026 — the result we fought for:
✅ Passport Request received
✅ Spousal open work permit approved
✅ Reunification with his wife finally possible

💡 If an old criminal inadmissibility is holding you back, don’t give up.
With the right legal strategy, evidence, and experienced Canadian immigration counsel, success is possible.

📌 Do not let youthful mistakes define your future.
Hire an experienced Canadian immigration lawyer and apply the right way.

Federal Court Settlement ≠ The End. It’s the REAL Opportunity. ⚖️📂

After a Federal Court settlement, IRCC gives a critical additional document request before redetermination by a different officer. This is not routine paperwork — this is your second chance to win.

🔑 What this stage allows:
• Cure deficiencies in the original application
• Show continuing financial support
• Prove ongoing purpose of visit
• Update changed circumstances
• Strengthen credibility before the new officer

⚠️ Important:
IRCC usually does NOT list specific documents. The burden is on the applicant (and lawyer) to submit everything relevant. Many people lose here because they stop legal representation after court.

🚫 Big mistake:
Hiring a lawyer only for Federal Court but not for the additional document stage. At Fateh Law Corporation, we call this incomplete representation.

✅ Our approach:
• Continued legal representation after settlement
• Strong reminder to IRCC that a wrongful refusal will return to court
• Reliance on Singh v Canada — avoiding the “boomerang effect” of repeated litigation
• In this case: 30+ supporting documents + detailed legal submissions filed

📌 A settlement must be honored in good faith — and we make sure IRCC remembers that.

👨‍⚖️ With 12+ years of litigation experience, Mr. Fateh fights from start to finish.

📞 Don’t stop halfway.
Trust Fateh Law Corporation. We fight for the final approval. 💪🇨🇦

❌ WRONGFULLY ACCUSED OF MISREPRESENTATION ❌

Our client was an elderly father, educated only up to Grade 10.
He simply wanted to travel from New Delhi to Canada to help his daughter with her newborn.

Instead, he was:
✈️ Denied boarding at the new Delhi airport, and
🚫 Hit with a 5-year misrepresentation ban after a poorly conducted interview by the Canadian Embassy.

👉 The reasons given?
• He said he filled the application himself, then explained his daughter helped him
• He mentioned two bank accounts, then later disclosed a third
• He bought tickets just 10 days before travel to support his daughter
• And shockingly — the officer felt it was “culturally odd” that the father travelled instead of the mother

📌 Even the officer admitted in the notes:
“Although not definite misrepresentation.”

Yet, despite doubt, a misrepresentation ban with life-altering consequences was imposed.

This meant our client could not see his daughter for five years.

⚖️ We challenged this injustice in the Federal Court of Canada.
💼 Costs were sought against the Minister.
✅ The Department of Justice agreed the decision was wrong.

📅 Settlement reached on January 28, 2026
🚫 Misrepresentation ban set aside
🔁 Case sent back for redetermination

Wrongful decisions like this happen far too often — and most people are told to accept them.
But if your case is genuine, it must be challenged.

🔴 IRCC cannot be allowed to abuse its powers.
