Case Details: AKS v. STS, the Chhattisgarh High Court granted a divorce on the grounds of mental cruelty and desertion under Sections 13(1)(i-a) & (i-b) of the Hindu Marriage Act, 1955.

The wife, after securing a PhD and high-paying job, began to taunt and humiliate her husband during the COVID-19 pandemic when he was unable to work.

She repeatedly called him unemployed and made unreasonable demands while he faced financial hardship. Eventually, she left the matrimonial home with their daughter, abandoned the son with the husband, and did not participate in the court proceedings.

The Court held that such conduct constituted mental cruelty that made continued cohabitation intolerable and justified a decree of divorce.

In a the Apex court has helped protect the rights and interests of a hashtag . The court has held that interpretation of the Muslim Women (Protection of Rights on Divorce) Act, 1986 must be done, keeping at the forefront hashtag , hashtag , hashtag and the lived experiences of women where particularly in smaller towns and rural areas, inherent patriarchal discrimination is still the order of the day.

The principal issue before the Hon’ble Supreme Court was whether gifts and properties bestowed upon the daughter or bridegroom at the time of marriage can be reclaimed by a divorced Muslim woman under the provisions of the Muslim Women (Protection of Rights on Divorce) Act, 1986.

The Court noted that Section 3(1) of the 1986 Act encompasses mehr/dower as well as any other property given to a woman at the time of her marriage. This statutory provision authorises a divorced woman to assert a claim against her husband in such circumstances and, where applicable, to seek the return of such property from him.

Emphasising the necessity of a purposive interpretation of welfare legislation to advance social justice, the Court observed:

“The Constitution of India prescribes an aspiration for all, i.e., equality, which is, obviously, yet to be achieved. Courts, in doing their bit to this end, must ground their reasoning in social justice adjudication.”

Consequently, the Supreme Court allowed the appeal and set aside the impugned judgment of the High Court. The respondent was directed to remit the payable amount to the appellant through bank transfer within three working days, and to file a compliance affidavit within six weeks.

The Court further clarified that any failure to comply with these directions would result in interest at the rate of 9% per annum.

Despite these grave allegations, the *Patna High Court* held that *“isolated acts of adultery”* are no reason to deny maintenance 🧾.
