The Supreme Court of India has directed every State to set up a dedicated Special Investigation Team (SIT) to probe suspected fraudulent motor accident insurance claims — a ruling with significant implications for MACT litigation across the country.
Case: The Oriental Insurance Co. Ltd. v. Tuni Pati & Ors.
SLP (C) No. 5582 of 2023 with Civil Appeal No. 6865 of 2026
Bench: Justices Ahsanuddin Amanullah and PB Varale
Order dated: 17 August 2026
Background: The matter began as a narrow dispute over whether a specific vehicle was genuinely involved in an accident. It expanded into a larger issue after the Court found the same insured vehicle was allegedly being repeatedly shown as the offending vehicle in multiple accidents to facilitate fraudulent claims.
Key Directions of the Court:
1)Every State to constitute a dedicated State-level SIT to investigate complaints of suspected insurance fraud
2)Insurance companies must refer all fraud-indicating claims to the respective State SIT
3)Top management of insurers will be held accountable if fraud cases are selectively referred ("pick and choose")
4)Court noted fraudulent claims strain insurers financially and ultimately raise premiums for genuine policyholders
This order strengthens the mechanism to w**d out manufactured and duplicated claims, and will shape how insurers, claimants' advocates, and Tribunals handle suspicious claim patterns going forward.
