CHANGE TO IRISH NATURALISATION RULES

The Courts and Civil Law (Miscellaneous Provisions) Act 2023, has amended certain provisions of the Irish Nationality and Citizenship Acts.

This came into place on the 31/7/23.

The ‘six week rule’ has been extended to 70 days per year with the provision for an additional 30 days in each year for exceptional circumstances (for example health reasons, employment, study)

Children born in Ireland who do not qualify for citizenship at birth can apply after 3 years, rather than 5.

This act has come into effect and will be applied for all existing applications also.

I will be reviewing the Act in more detail after my annual leave. And will be back for
Immigration consultations from the 1st September.

To everyone who applied for the Undocumented Scheme and are still waiting for their results, we are with you.💚We know that this waiting period is very difficult and stressful for people, we understand the frustration.

☘️Justice for the Undocumented and MRCI campaigned long and hard for this, and we want everyone to get their results as soon as possible.

📥The processing of applications is in the hands of the Department of Justice, we don't have any influence or control over the timeframe for issuing all results.

🎉There is good news. Out of the 8,311 people who applied, almost 3,000 people already got their papers, 750 of those were issued in the last month! So we can see a steady increase, and more are being issued everyday.

The department have informed us that they cannot give an exact timeframe for a number of reasons. There are a lot of factors at play in issuing results in the scheme. It is not just about the day you applied, it depends also on the vetting process, the evidence provided, the immigration history of the applicant, etc.

✅Rest assured that if you meet the criteria and provided the evidence, you can be confident of a positive result.

🙏We are hopeful that we will continue to see a speed-up in the issuing of results over the coming weeks and months.

For any existing clients looking to apply please contact me by email tomorrow morning. I’ll be taking a few weeks off in August for new consultations and back fresh in September once schools reopen.

⏳❓What are the waiting times for Garda Vetting when applying for the Undocumented Scheme?

1️⃣Vetting Invitation: Within 10 days of applying all applicants over 16 should get the vetting invitation form. If you do not receive this within 3 weeks please 📨email [email protected] and we will support you to get it. 📝You need to print this form, fill it with a pen, sign and tick the consent box, scan it and email it back to the email address provided.

2️⃣After 8-10 weeks you will receive a link by email to complete your vetting online. You just click the link and follow the instructions. You will need to put all the addresses where you have lived since birth. Make sure to leave no gaps.

3️⃣After you complete your vetting you will be provided with a link to track the progress of the vetting. Once you see a notification of ‘disclosure viewed’ it means that the Department has viewed your vetting report. ➡️Don’t worry if you then see a notification of ‘download expired’, this is normal.

✅Please note that it is very common to wait more than 2 months after the ‘disclosure viewed’ notification before receiving the result of your application. That is completely normal. There is nothing further you can do at this stage. Just wait for your letter to arrive.
