Last year over the course of several months we offered all over 70’s FREE Ordinary Powers of Attorney, with no hidden catch. It’s just us trying to do what we can when every little helps.

As we enter another new period of national lockdown, our solicitors and legal advisors will be offering FREE Ordinary Powers of Attorney for ANYONE over 70, clinically vulnerable, or looking after someone who is clinically vulnerable.

We are pleased to announce that we will continue to provide this FREE service until the end of February 2021.

An ordinary power of attorney gives you the power to choose someone to help you with your general finances, such as going to the bank or post office and dealing with financial providers on your behalf.
It is NOT a lasting power of attorney that protects you if you lose your capacity.

Lasting Powers of Attorney can often be a lifeline for a family that would otherwise be ‘lost’ without them.

Last year the Government launched a campaign to educate all people on the importance of putting these significant legal documents in place. Their campaign is now stronger than ever as we move into 2021.

Quite simply, there are two types of Lasting Powers of Attorney ( LPA) that protect yourself and the people immediately around you.

One LPA is for all things ‘Property and Finance’ and one LPA is for ‘Health and Welfare’ decisions. Both have huge powers and allow people you trust to speak up for you, if you are unable so ‘to act as your voice’.

They are more relevant than ever, for ALL people, young, old, healthy and not so healthy too, as the truth is none of us know what uncertainty lies ahead.

What we DO know is the value and peace of mind these documents bring to families if they are ever called upon. That is hard to put into words.

Lots of conversations with lovely passers by this morning as we did some front door seal fixing!

The theme of the day ‘I don’t have a Will’ and ‘I don’t need a Will’.

It was actually really hard to hear that people still hold this view.

Please don’t fall into that trap.

Joint Tenants or Tenants In Common?

Buying a property is one of the biggest purchases that a person will ever make so it's best to get it right!

When two or more individuals purchase a property, often it is unknown how you own your property in respect to the other owner/s.

The two options are 'Joint Tenants' (JT) or 'Tenants in Common' (TIC).

So what difference does this make to your Will?

If you die as a JT the land registry takes priority over your Will. This means your property will automatically pass to the surviving owner or owners (like a joint back account). On the other hand, TIC allows for your property to pass as you decide through your Will.

With this in mind, we ask you to think about your own property - how does this information impact you?

Updating your Will is a must when buying or owning a property. When setting aside money for legal fees for conveyancing, Wills should always be factored in. The risk of not having a Will can lead to unintended things happening to your partner or family which can be both devastating and irreversible.
But it can also be avoided!

Supporting someone through grief

1. Never avoid them.
2. If you have memories of the person who has passed then share them together. Remembering that new memories cannot be made and they may be hearing your story or memory for the first time.
3. It is hard to know what to say. Nothing you say can change what’s happened. However, often just saying I’m sorry is enough.
4. Never compare the loss of a loved one to losing a pet. Loss is hugely personal but if you have lost a loved one too, then remind them they will survive through grief and one day even smile and laugh again. Loss never goes away but people adjust to living with it.
5. Grief (even when half expected) can cause shock. People often forget to eat or don’t feel up to shopping ( and risk bumping into people) so offering or dropping off a small cooked meal can be a great comfort.
6. Many families have one person who is admin minded or takes on all the house admin. If that person passes first then the survivor is not only dealing with grief but also learning finances for the very first time. Often, this just adds to feeling overwhelmed. Offer some practical help and point them to a professional for some guidance on the legal side of things. Most professionals will offer a free first meeting and can often answer some important initial questions which can help alleviate common feelings of panic.
7. Don’t be afraid to talk about the person who has passed. Embrace their time with us and reminisce.
8. Make a private note of the landmark dates such as birthdays and anniversaries where grief can be so raw and be there to offer support. One of the hardest things about grief is that from the inside looking out, the world just continues, when their world has just fallen apart so taking some time to call someone and ‘check in’ will be a thoughtful gesture.
9. Remind them it’s okay to not be okay. Perhaps look up some details of nearby bereavement counsellors and leave them noted down for them to read about in their own time. They are commonly used and sometimes not for months or even years after someone has passed away. There is no time limit on these things. We are all different.
10. Don’t be afraid to make them laugh or share something funny or silly that you did or what you heard. It may even make them smile.
