A Power of Attorney allows you to authorise a lawyer or representative in Spain to act on your behalf, so the transaction can proceed without your physical attendance at every stage.

The process with us is straightforward. You attend our office in Cardiff or Penarth with your identification documents and sign the Power of Attorney in front of our Notary Public. We then certify a copy of your passport where required, arrange Apostille legalisation through the FCDO, and courier the completed documents directly to your lawyer or the requesting party in Spain by DHL. You will receive a scanned copy of the documents and the DHL tracking number.

What Does a Notary Public Actually Do?

Most people go their entire lives without needing a Notary Public, and then find themselves needing one urgently, often with little understanding of the role.
A Notary Public authenticates documents and signatures for use outside England and Wales, so they are recognised as genuine by authorities in other countries.
This is a distinct legal profession from a solicitor, regulated separately by the Faculty Office of the Archbishop of Canterbury.

Day-to-day work includes witnessing Powers of Attorney, certifying true copies of documents such as passports and degree certificates, preparing Affidavits and Statutory Declarations, verifying company signatories, and arranging Apostille legalisation once notarisation is complete.

What Is an Apostille? A Plain-English Explanation

We are frequently asked what an Apostille is, so we wanted to explain this clearly.
An Apostille is a certificate issued by the Foreign, Commonwealth and Development Office (FCDO), confirming that a signature or seal on a UK document is genuine, allowing it to be recognised in another country.

This is typically required for documents such as birth, marriage, and death certificates, academic qualifications, Powers of Attorney, and DBS or ACRO certificates, where these are being used in one of the 120+ countries that are members of the Hague Apostille Convention.

The process generally involves two steps: notarisation of the document, where required, followed by verification and certification by the FCDO.

Affidavits and Statutory Declarations: Understanding the Difference

We are asked to notarise Statutory Declarations and Affidavits regularly, and it is common for clients to be unsure of the distinction between the two.

A Statutory Declaration is a formal written statement made under the Statutory Declarations Act 1835. No oath is required; the person instead declares the contents to be true. This is commonly used where no other supporting document is available, such as marrying abroad without a Certificate of No Impediment, or confirming a change of name.

An Affidavit is a written statement sworn under oath (or affirmed) before an authorised person (for example, a solicitor, a notary or a commissioner for oaths), and is used principally as evidence in court proceedings.

For documents intended for use outside the UK, notarisation by a Notary Public is generally required, as a solicitor's signature alone may not be recognised internationally.

We can assist with the witnessing and notarisation of Affidavits and Statutory Declarations; however, the information and statements to be included must be supplied by the person making the declaration, with or without assistance from their lawyer or adviser. We can then adapt the document where required so that its form and ex*****on are suitable for signing and notarisation in England and Wales.

Vietnam Joins the Apostille Convention from 11 September 2026

We are pleased to share an important update for anyone requiring UK documents to be legalised for use in Vietnam.

From 11 September 2026, Vietnam will become a member of the Hague Apostille Convention. This means that, going forward, an FCDO Apostille alone will be sufficient for UK documents to be recognised in Vietnam — the additional step of obtaining a stamp from the Vietnamese Embassy in London will no longer be required.

This change will benefit individuals with family ties to Vietnam, businesses trading with or investing in the country, and anyone applying for a Vietnamese work permit using UK qualifications or police certificates.

Please note that this change is not retroactive — documents submitted before 11 September 2026 will still require the current three-step process, including embassy legalisation.
