Legal aid granted for representation in school exclusion reviews

In a landmark development for children’s rights and access to justice, the Legal Aid Agency has, for the first time, granted exceptional case funding (ECF) to cover legal representation in a school exclusion review.

The decision applies to Independent Review Panel (IRP) hearings, which review a governing board’s decision not to reinstate a pupil after exclusion. It follows years of sustained legal challenges, policy advocacy and campaigning.
The breakthrough came in R (CWJ) v Director of Legal Aid Casework and Lord Chancellor [2025] EWHC 306 (Admin); May 2025 Legal Action 34. Stephanie Harrison KC and Ollie Persey of Garden Court Chambers, instructed by Coram Children’s Legal Centre, successfully argued that the right to a fair hearing under article 6 of the European Convention on Human Rights can apply to IRP proceedings.
Following the ruling, the lord chancellor revised official guidance, removing a blanket prohibition that had previously prevented ECF from being granted for such hearings
