🏠 What Are the Rules on Gifting a Rental?

Many landlords hope to one day pass their property portfolio on to their children or grandchildren. So what are the rules – and tax implications – around gifting a rental?

Understandably, many landlords take great pride in being able to pass property (and the long-term security that it brings) on to their descendants.

For landlords hoping to leave such a legacy, here are some key points on the rules and exemptions around inheritance tax (IHT) and gifting.

The seven-year rule ⤵️

👉 You can give cash or assets as you wish and not pay a penny in IHT if you then live for seven years afterwards.
👉 You’re also allowed, under what’s known as an annual exemption, to give away up to £3,000 per year free from IHT. This can be given to an individual or several people, as you please.
👉 If you die less than three years after making a gift outside of the annual exemption, then that gift will be taxed at the 40% rate.* If you die between three and seven years after, there is a sliding tax scale ranging from 32% to 8%.
👉 There is a £325,000 tax-free IHT threshold. Any non-exempt gifts made in the last seven years of your life use up this threshold. (This is calculated chronologically.)
👉 There are also exemptions for gifts for weddings or civil partnerships.

🏠 Selling a property

Rules also apply to selling your property to a loved one at below-market rate. For example, if your rental is worth £500,000 and you sold it to your son or daughter for £100,000, then the £400,000 discount could be subject to IHT (the seven-year rule applies).

🏠 What about setting up a trust?

Some landlords move their rental property into a discretionary trust to remove its value from their taxable estate. However, the property only becomes exempt if you live for seven years after the transfer. There are also capital gains implications when you transfer a rental into a discretionary trust.

💰 Valuing Your Property: Don’t Make This Mistake 💰

A recent headline in a national newspaper sums up the common mistake many people make when trying to determine the value of their home.

Here’s the headline. Can you spot the problem? ⤵️

“Cliffside home fails to sell at auction for £250,000 - despite being worth more than FOUR times the price.”

The headline ignores a fundamental property rule: a home is only worth what someone is willing to pay for it. It’s only worth a million pounds if it actually sells for that price.

As it turns out the home in the article is just a few metres from a rather steep and very scary cliff-drop (the result of coastal erosion).

So the £1 million ‘valuation’ is based on what a similarly sized home in the area might sell for – if it didn’t have a serious material defect.

It’s a valuable (admittedly pretty extreme) lesson for anyone looking to list their home.

Many people come to the market with a valuation in mind, based on vibes or neighbourhood gossip.

The owner will often say: “But the house across the road sold for ### amount, and it’s the same as ours.”

While it’s useful to consider what similar properties in the area sell for, this information should be used as a guide only, because:

⚠️ Size isn’t everything. The home across the street may have the same footprint but with more modern décor, a better outlook or greater kerb appeal.

⚠️ Markets change. Right now, we’re in a buyer’s market, meaning property hunters are much more cautious. Prices remain resilient, but it’s a different place to the seller’s market of a few years ago.

💰 Getting an accurate valuation

Speak to three reputable agents and be wary if one agent gives you a valuation that blows the others out of the water.

They’re likely to be telling you what you want to hear to win the instruction. They know you’ll have to drop the price eventually.

There are lots of articles in the press right now about the importance of accurate pricing.

That’s because homes that are overpriced and require a price drop take longer to sell (Rightmove puts the delay at 91 days).

So don’t waste your time with agents who are playing games. Instead, work with an agent who is ambitious but also honest.

Also, think carefully about how you present your home – a clean, clutter-free home is more appealing to buyers.

Sensibly priced, well-presented and professionally marketed homes are definitely selling right now.

But it’s important to be realistic and proactive.

📝 How the Renters’ Rights Act is Changing the Buy-to-Let Market 📝

Three months on from its introduction, how is the Renters’ Rights Act shaping the rental market? Let’s take a look.

It was billed as the biggest overhaul of the rental market in decades.

A once-in-a-generation reset that, depending on whom you spoke to, would either crush rogue landlords like cockroaches or the rental market as we know it.

As it turns out, neither of these predictions has proved true – so far at least.

But the Renters’ Rights Act (RRA) is having an impact.

Many tenants report feeling more secure following the abolition of no-fault evictions.

And some landlords have sold up. (However, many other landlords have stayed put, and some have even expanded their portfolios.)

Reports indicate that the RRA is also influencing the behaviour of tenants and landlords in other ways.

🛒 Tenants are shopping around more

The RRA banned bidding wars and made it illegal for landlords to accept or encourage rent above the advertised price.

This appears to have made the application process less frenzied, as good tenants no longer worry about being rejected solely on the basis of price.

As a result, they are taking more time to do their homework and compare properties.

👉 What this means for landlords

Responsible landlords who keep their rentals in good condition, understand the local market, and set their rents appropriately have nothing to fear.

Demand for rental properties is still strong (supply is still at least 20% down on pre-pandemic levels). Hence, competition is healthy for well-kept, reasonably priced rentals.

However, with tenants placing greater emphasis on research, your marketing needs to be slick and your photography professional-standard to show your property at its very best.

👉 Rent-setting

Another outcome of the RRA stems from the rule that landlords can only increase rent once a year, and not within the first 12 months of a tenancy.

This has made rent setting an even more critical task for landlords.

Set the rent too low, and you’ll have to wait a year to redress the imbalance.

Then, of course, there is the possibility that when you come to increase the rent a year later, the tenant challenges the hike if they feel it is unreasonably large.

👉 What this means for landlords

As always, it’s best to get the rent right the first time.

It’s helpful to take an evidence-based approach (if you’re ever challenged, you’ll have data to draw on).

A reputable letting agent can advise you on the market norms and provide you with comparable rental evidence based on agreed lettings.
