🏡 Could a Property Protection Trust help protect your home and your family’s inheritance?

For many of us, our home is our biggest asset. A Property Protection Trust within your Will can help make sure your share of the property ultimately passes to the people you choose.

It can be particularly useful for couples because, after the first person dies, their share of the home can be protected in trust while allowing the surviving spouse or partner to continue living there.

It may be worth considering if you:

• are concerned about the potential impact of future care home fees on the family home
• want to protect your children’s inheritance
• have children from a previous relationship or a blended family
• want to provide security for your partner while protecting your share of the property for your chosen beneficiaries
• want greater control over what happens to your home after your death

⚠️ A Property Protection Trust is not a guaranteed way of avoiding care fees, and the rules surrounding deprivation of assets must always be considered. However, when properly advised upon and drafted, it can be a very useful part of your estate planning.

📣 Good news for separating couples.

The Government has confirmed that the Family Mediation Voucher Scheme has been extended until 31 March 2029. Eligible families may be able to receive a contribution of up to £500 towards the cost of family mediation.

Mediation can often help separating couples and parents reach agreements about arrangements for children or financial matters without immediately turning to court proceedings. It can be a quicker, less stressful and more cost-effective way of resolving disputes.

However, mediation isn’t suitable for every situation, particularly where there are concerns about domestic abuse, safeguarding or a significant imbalance of power. An authorised family mediator will assess whether mediation is appropriate and whether you’re eligible for the voucher scheme.

⚖️ Family Law Update | Non-Molestation Orders

The pilot scheme allowing HMCTS to automatically notify the police when certain Non-Molestation Orders are made has now been extended until July 2027.

The aim is to improve communication between the courts and the police, helping to reduce delays where qualifying orders are in place.

It’s important to remember that not every Non-Molestation Order is automatically shared. The scheme remains a pilot and only applies in selected courts and areas. If you have a Non-Molestation Order, don’t assume the police have been notified. If you’re unsure how the order applies in your case, it’s always worth seeking legal advice.

If you believe a Non-Molestation Order has been breached, report it to the police immediately. A breach of a Non-Molestation Order is a criminal offence.

⚖️ From today (13 July), the new Family Court fees are now in force.

If you’re considering making an application to the Family Court, it’s worth being aware of the updated fees before you begin. Whilst the increases are relatively modest, they are another reminder that court proceedings come with a financial cost.
