Since 1 July 2026, designers have a dedicated route to apply for the Global Talent Visa. The design industry is one of the arts and culture fields for Global Talent, and applications are under this route are judged by the Design Business Association DBA on behalf of Arts Council England.

A Design Industry endorsement application must be built around three core components: a professional CV, three letters of support and up to ten individual pieces of evidence.

✅The CV establishes the applicant’s career stage and professional design history.
✅The letters explain the applicant’s achievements, reputation, UK plans and contribution.
✅The evidence proves that the applicant meets at least two of the required evidence categories for endorsement.

FAQ: ILR UK 2026

1. Has the 10-year ILR rule come into force?

💡No. As of July 2026, the standard ILR qualifying period remains five years for most routes under current law. The 10-year earned settlement proposal has been consulted on but has not yet been enforced. All ILR applications submitted now are assessed under the existing legal framework.

2. Will the proposed changes apply to me if I am already in the UK?

👉🏻The government’s stated intention is that the new rules will apply to people already in the UK who have not yet received ILR. The consultation also asked about transitional arrangements and protections for those already part-way through the qualifying period. No decision on transitional arrangements has been confirmed. This is the area of greatest individual uncertainty and individual legal advice is essential.

3. Can I apply for ILR before the proposed changes come into force

✅Yes, if you currently meet the eligibility requirements under the existing rules, you can apply now. Applications are assessed under the rules in force on the date they are submitted. If you become eligible before the new rules are enacted, applying immediately is the clearest way to preserve access to the current five-year pathway. At JV LEGAL we strongly advise anyone approaching ILR eligibility to take advice and apply without delay.

Do you meet ILR eligibility or are you concerned about the proposed changes?

At JV LEGAL we advise on ILR applications under all main routes. If you are eligible now or will be before the new rules take effect apply without delay.

Global Talent Visa (Digital Technology route)

1. Have you been recognised outside your employer for your work in the digital technology sector, in press, at conferences, through awards with a limited number of recipients?

2. Is your most significant work something you built or led that has had measurable impact on the field and not just on your company?

3. Would a senior leader in your industry know your name or your work based on what you have done, and not because they work with you?

✅ If you answered YES to most of these Exceptional Talent route may apply. If you answered NO to most Exceptional Promise is likely the correct starting point.

💡Common mistake is overestimating pathway eligibility and choosing Talent when Promise is the right route. Exceptional Talent is a high standard: it requires evidence of sector-wide impact and recognition, not just internal seniority and minor publicity. Most people applying for the Global Talent Visa are more qualified than average, but that does not automatically mean they qualify under the Exceptional Talent route immediately. A rejected Exceptional Talent application because the evidence only supports Promise wastes the application fee and resets your timeline.

Andy Burnham is the frontrunner to become the next UK Prime Minister following Keir Starmer’s resignation.

Burnham’s formal immigration policy position is still developing but he has made some statements:

1. On the campaign trail in June 2026, Burnham said UK net migration must “fall further.” This is his clearest and most recent statement of direction on overall migration levels.

2. A spokesperson for Burnham said on 28 May 2026: “Andy’s been very clear that he recognises that towns across this country want an immigration system to be fair and they want to know that the government has control — and it is right to pursue root and branch reform.”

3. Speaking to BBC Radio Manchester, Burnham said: “We need to make greater use of detention so that people who have got no basis for a claim are not actually admitted into the country. So that’s dealt with quickly and there’s a speedier return.” He also agreed with Reform leader Nigel Farage that the country needs to “get back to a sense of order.”

4. Burnham supports extending ILR qualifying period to 10 years, he has indicated support for Home Secretary Shabana Mahmood’s plan to lengthen the qualifying period for Indefinite Leave to Remain, describing it as necessary for “meaningful integration.”

5. While supporting stronger enforcement, Burnham has not advocated closing legal work visa routes or fundamentally dismantling the UK’s points-based immigration system. His comments suggest continued recognition that employers in some sectors rely on international recruitment to address skills shortages and support economic growth.

It would be premature to assume that a Burnham leadership would result in major departures from current Labour immigration policy. The current government has already implemented significant reforms affecting sponsorship, overseas recruitment and long-term immigration planning, and there is no indication that those changes would be reversed.

❗️Letters that appear templated, share identical formatting or lack proper digital verification are often discounted entirely.
❗️Definition of “innovation” has expanded beyond technical ability. Assessors now expect to see real-world influence: evidence that your work has been adopted, cited, or inspired others in the sector.
❗️A common reason for refusal is working for an employer that doesn’t meet Tech Nation’s definition of a product-led digital technology company. Traditional IT service or consulting firms are explicitly excluded.
❗️Not all awards carry the same weight, and only credible industry publications are recognised as evidence of national or international standing.
❗️General statements like “I was part of a successful team” do not suffice. Assessors require tangible proof of what YOU specifically achieved, so evidence such as product growth metrics, personal project ownership or independent third-party testimonials can help draw a clear line between your role and the outcome.

💡If your achievements are not framed the way Tech Nation needs to see them, they do not count, regardless of how significant they are.

The compliance environment in 2026 is fundamentally different from two years ago. A passive approach relying on existing systems without regular review is no longer adequate. The following actions are the minimum that any licensed sponsor should be taking now.
