Very happy that we have ensured that someone who had given up their career, social life and interests to care for her elderly mom for many years, got the decision and outcome she deserved. After our intervention, the Council decided it would no longer take her mother's property into account as part of her mother's financial assessment for residential care, ensuring my client could remain living there.

The Sunday Times: Our Company Director was interviewed and quoted in an article in The Sunday Times Newspaper, which featured on 28.12.205. The article was about the increasing efforts by Local Authorities to try and look into the history of bank transfers / statements (sometimes going back many years) to try and find incidents where they believe a service user has tried to deliberately deprive themselves of an asset (money) to try and reduce their care contributions. Amazing news, which was just in on time for Christmas. We successfully challenged the Council's decision to move an elderly vulnerable lady to a cheaper care home, further away from her family. As a result, the Council has now agreed to increase her personal budget, enabling our client to remain in the home where she has lived and thrived for the last two years. care

A lot of problems arise when a service user wants to move to another Local Authority to live closer to their family. Many Local Authorities involved are unfamiliar (or simply ignorant) with regards to the processes involved, issues around Ordinary Residence (which LA pays for the care after the move) and are wrongfully telling relatives to pay Top Up fees. If you are, or know someone, in this situation, please do not hesitate to ask them to give us a call as we can successfully guide them through this process

The State of Health Care and Adult Social Care report has highlighted that, in addition to some promising signs, many challenges in the (adult) social care sector remain, including:
1) Navigating the care system remains challenging, especially for people with needs that are more complex to meet or who have limited advocacy.
2) Vacancy rates remain high
3) Demand for support funded by a local authority (LA) continues to rise (4%)
4) Delays in hospital discharges due to delays in accessing rehabilitation, reablement or recovery services
5) Some homecare providers have said they are handing back LA contracts

This week we had two cases where we successfully overturned a Council's previous decision to include the value of the property within the financial assessment. Both clients and their family were absolutely delighted with the outcome

Shocking delays in completing financial assessments continue to be an issue we often come across, which subsequently often result in service users (or their relatives) receiving a huge accumulated bill (outstanding debt). There has yet been another example of this in the media recently, where an elderly man was left owing nearly £5,000 to Kingston Council after it wrongly paid for his live-in carer for six months. In this case, his home care had started in April 2023, for which he initially received £189 per week from the Council. However, when the Council completed its FA after 6 months, it concluded he was actually not eligible for this and told him to repay the £4,860 already paid into the direct payment account. Shocking. What is your experience in terms of delayed financial asessments?

Unpaid carers play an important role in our society.
Most people will have caring responsibilities at some point in their lives with more than 5 million people in England and Wales providing unpaid care in 2021.
There is government support available for carers. However, only a small percentage of carers approach their local authority for help: in 2021, only 8% of carers in England did so and of those 1 in 4 ended up receiving direct support.
Local Authorities need to do more to reach out to the carers in their community, and use a variety of means to do so. We believe this needs more funding, including support to Carer Centers.
