NEW PROPOSALS ON EARNED SETTLEMENT IN UK
👉The standard route to settlement is proposed to increase from 5 years to 10 years. However, some groups may qualify earlier based on their contribution to society.
Here are the key points:
- English Language
Those who speak English to a degree-level standard could qualify for settlement in 9 years.
- Higher-Rate Taxpayers
Those paying the higher rate of tax could qualify in 5 years, and top-rate taxpayers could qualify in 3 years—similar to Global Talent visas.
- Public Service Workers
Doctors, teachers, nurses and others working in public service could qualify in 5 years.
- Volunteers
Those who volunteer (subject to consultation) may qualify between 5–7 years.
- Partners of British Citizens
No change—still eligible for settlement after 5 years.
- British Nationals Overseas (Hong Kong)
Will continue to qualify after 5 years, in recognition of the UK’s commitments.
- Windrush & EU Settlement Scheme
No changes to these schemes.
👉Those on Benefits:
- If benefits were received for less than 12 months → settlement after 15 years.
- If benefits were received for more than 12 months → settlement after 20 years.
👉Illegal Entry
Those entering the UK illegally could see settlement delayed up to 30 years, as part of efforts to encourage legal routes.
👉Refugees on Core Protection:
Eligible for settlement after 20 years.
👉Work & Study Routes
Those coming via “work and study” visas may qualify earlier than 10 years, depending on their specific route.
