Important information for tenants with rent arrears! Yesterday, the government extended the ban on evictions being carried out in England to 22nd February 2021. This is obviously a necessary step to protect tenants suffering financial hardship as a result of Covid-19 issues. However, and this is really, really important for tenants to be aware of, what the government has added in with this extension is a change to say that rent arrears that have accrued during the period of Covid-19 lockdown/tiers/furlough/job losses etc. since 23rd March 2020 can now count towards the level of rent arrears that means evictions can take place. Before the change yesterday, an eviction could not take place unless the rent arrears figure was equivalent to 9 months' rent or more, and all of this rent arrears related to periods before 23rd March 2020. Clearly, this is bad news for tenants with rent arrears due to the Covid-19 period. If you are such a tenant, you must seek advice straight away. Lots of landlords will be encouraged by this change to try to force tenants out of their homes. Important Information for Tenants! The government has just extended the ban on evictions being carried out for a further 6 weeks from 11th January 2021. This means that there will be almost no evictions until at least 22nd February 2021. Whilst this is clearly good news and makes a lot of sense in light of the new lockdown restrictions, there is nothing to stop landlords serving notices on tenants saying they must vacate their property. With the suggestion today that all of England will be going into Tier 4 restrictions from later this week, tenants need to be fully aware of what the current regulations are for landlords wanting to get tenants out of their homes. Since the Covid-19 regulations came into force in March 2020 there have been many changes to the usual requirements for landlords seeking to recover possession of their properties. Tenants! You must read this! Landlords, who have had the upper hand over tenants for over 1,000 years, are now calling their tenants thieves! Honestly! A landlord petition has been started saying that any tenant who is more than 2 weeks in arrears on their rent should be evicted. This is a petition on the UK Government and Parliament website and states "You can't go into a supermarket and steal your weeks groceries ... Not paying rent is also theft with the Landlord being the victim". In just over 1 week, almost 3,500 landlords have signed this petition. Calling tenants in arrears thieves is disgusting! The gloves are now off. We are going to help tenants protect themselves. We have already seen a definite shift in the behaviours of some landlords after the stay on possession proceedings came to an end at the start of last week. Landlords are beginning to put significantly more pressure on tenants and are using the fact that courts are now progressing claims to try to make tenants do what the landlords want. Remember, landlords can only regain possession of their property either by voluntary surrender of possession by a tenant, or the ex*****on of a warrant for eviction. Anything else the landlord or agent might tell you about you having to be out is wrong. It's as simple as that. If ever there was a time for tenants to make sure they are getting help from a tenant organisation, it is now. There are many stories coming out of landlords unlawfully evicting tenants; using "lawyers" who are not entitled to bring proceedings against tenants; and generally putting unnecessary pressure upon tenants who are entitled to quiet enjoyment of their homes. We are also hearing of bogus landlords offering properties that can only be viewed remotely and which might not even exist or, at best, are not owned by the person offering the let. The stay on possession proceedings against residential tenants has now come to an end. Landlords are able to issue court proceedings to get tenants out of their homes. If you are a tenant. you must act straight away if any of the following apply to you:

1. You are thinking you might want to, or might have to, move out.
2. You are in rent arrears.
3. You think you might not be able to afford your full rent going forward.
4. Your landlord or agent is pressuring you because of rent arrears.
5. You have been served with a section 8 notice, a section 21 notice, a reactivation notice or a claim form for possession.

Landlord groups are now saying that landlords need to consider alternatives to court action when they want a tenant to leave their home. This gives all tenants a great opportunity to get a deal done that suits you best - not what suits the landlord best.

As the end of the stay on possession proceedings rapidly approaches, the government and the courts have issued further guidance about how the process will work going forward. These changes are very complicated. There will be a proportion of landlords and agents who will use the confusion to try to bully tenants out of their home. According to landlord trade body LandlordZone, 50% of tenants have not paid their rent in full since the beginning of coronavirus in March of this year. That is a lot of rent arrears.
