Cohabiting? Here’s why a Will matters

💬Why “common law marriage” could leave your partner unprotected

💡 Living together doesn’t give you the same legal rights as marriage or civil partnership - “common law marriage” isn’t recognised in the UK.
Joint assets (like a home or bank account) usually pass automatically to the survivor.
Sole assets (like a house in one partner’s name) won’t pass to the other unless named in a Will. Without one, intestacy rules apply - which could leave your partner with nothing.
Example: If Bette owns her house and dies without a Will, it passes to her parents - not her partner Ava. Ava may have to go through court to claim support.
Inheritance Tax (IHT): Married couples benefit from spouse exemption. Cohabiting partners do not - meaning tax could force the sale of a home or assets.
👉 If you’re not married (and don’t plan to be), making a Will is essential to protect your partner and your estate.

🔥 This Week’s Legal Insight: Spotting the Signs of Financial Abuse
Financial abuse is one of the most insidious forms of exploitation - and it’s on the rise. It doesn’t always happen in the shadows; sometimes, it’s committed by the very people we trust the most.
Financial abuse can happen to anyone - but the elderly and vulnerable are particularly at risk. Sadly, it’s often carried out by those in a position of trust, including family members, carers, or even attorneys appointed to help manage finances.
💡 What does financial abuse look like?
• Unexplained cash withdrawals or bank transfers
• Bills left unpaid without reason
• Being charged excessively for basic services
• Pressure to sign documents or make gifts
• Misuse of Powers of Attorney (e.g. mixing finances, taking money for personal use)
These red flags can leave victims anxious, isolated, and financially insecure.
🛡️ What can you do?
• Speak up if something feels wrong - trust your instincts.
• Contact the police, social services, or the Office of the Public Guardian if you suspect abuse.
• In some cases, the Court of Protection can step in to review or remove attorneys or deputies.
