In a rare and very significant step, the Health and Safety Executive (HSE) has recently authorised a Crown Censure against the Ministry of Defence over the 2017 Challenger 2 tank explosion at Castlemartin Range.

The MOD has a duty of care to ensure its service personnel are safe and free from harm so far as is reasonably practicable and the alleged failures in that duty following this explosion very tragically claimed the lives of Corporal Darren Neilson and Corporal Matthew Hatfield and left another soldier with life-changing injuries.

Our expert, Diane Askwith, comments:

“Those who dedicate their lives to keeping the nation safe should expect nothing less. There should be full accountability for everybody involved in decision making, including the MOD’s contractors directly involved in work likely to pose a health and safety risk. Service personnel must always be a priority to avoid needlessly caused deaths of our service personnel. The trauma which the families and loved ones go through should never be forgotten. I really hope the involvement of the HSE will help drive forward meaningful improvements to the safety of those who serve”

We are deeply saddened by the recent loss of British service personnel in three separate incidents over the past few weeks, including the deaths of three Royal Navy crew members in Devon, a British Army soldier in Iraq and a Soldier who died after falling from a horse at the Royal Windsor Horse Show. Our thoughts and heartfelt condolences are with their families, friends, colleagues, and all those affected by these tragic losses.

These events are a sobering reminder of the dedication, courage and commitment shown by our Armed Forces every day. The risks undertaken by military personnel, both at home and overseas, are often unseen by the wider public, but their service and sacrifice should never be forgotten.

We extend our deepest sympathies to all those grieving at this difficult time.

There is a growing amount of publicity around the 3M defective ear plug claims, with some firms suggesting these claims are not against the MOD.

That may be technically correct in part, but what is often being overlooked is that many of these cases may also involve allegations of negligent exposure by the MOD itself, including unsafe systems of work, failures in hearing protection protocols, inadequate supervision, and prolonged exposure to damaging noise environments.

If potential claimants are only being advised to pursue part of the claim, there is a real risk of significant under-settlement and failure to recover the full value of the damages they may be entitled to.

This is particularly concerning given reports that thousands of individuals have already signed up to pursue these claims.

Anyone considering a hearing loss or defective ear plug claim should ensure they obtain genuinely specialist legal advice from lawyers experienced in military claims.

The difference between pursuing only a product liability claim and pursuing the full scope of liability could be substantial.
