Your Will records your wishes and identifies who should manage your estate.

Probate is part of the legal process of administering that estate after death. Depending on the assets involved, an executor may still need a Grant of Probate before they can deal with property, savings or other significant assets.

Probate can also involve valuing the estate, dealing with outstanding liabilities and eventually distributing assets to beneficiaries.

When you make an LPA, you can also consider whether you would like to name a replacement attorney.

A replacement attorney is there to step in if an original attorney can no longer act on your behalf.

It is another reason choosing an attorney involves more than simply writing down the first family member who comes to mind.

Think about who you trust.

Think about whether they would feel comfortable taking on the responsibility.

And think about whether you would want another trusted person named if circumstances changed later.

Once you have chosen who you trust and completed the document, it still needs to be registered with the Office of the Public Guardian before it can be used.

It is an important part of the process, because an unregistered LPA cannot simply be put into action when your family suddenly needs it.

For a Will to be legally valid, it normally needs to be signed in the presence of two adult witnesses, who then sign it in your presence.

There is another important detail.

If someone who is receiving a gift under the Will acts as a witness, the gift intended for them can fail.

The same issue can apply where the witness is the beneficiaryโ€™s spouse or civil partner.

It is a small procedural detail with an important consequence.

That is why properly preparing a Will involves more than simply writing down your wishes.

They can be appointed so they are able to act separately as well as together, or so particular decisions have to be made jointly.

That choice can affect how practical the arrangement is for your family.

When a property is owned jointly, how it is owned matters.

Joint tenants and tenants in common are treated differently when one owner dies.

With joint tenancy, ownership normally passes automatically to the surviving owner.

With tenants in common, each owner has a distinct share that can form part of their estate.

That is why estate planning is not only about writing down who you would like to inherit.

It is also about checking that the way your assets are owned works with those wishes.

Once your Will has been completed, the original document must be kept securely.

It is also important that your executors know where it is stored and understand how it can be accessed when required.

Keeping it somewhere secret may feel safe, but it can create difficulty if nobody knows where to look.

Leaving it loose in a drawer creates a different risk.

Secure storage or a recognised registration arrangement can help protect the original while making its location clear.

You do not need to give every family member a copy.

The important thing is that the right family members know that the Will exists and where the original can be found.
