Taking your business overseas?

Your brand may be ready for new customers, but does your trade mark protection cover the markets you have in mind?

A UK registration does not give worldwide protection. Selling online or working with an overseas distributor does not automatically extend its territorial coverage.

Contact Corpinal IP to discuss your brand, target markets and whether professional advice would help with your expansion plans.

You created the brand, but is the trade mark owned by you or your company?

A founder and their limited company are separate legal persons. A trade mark registered personally is not automatically the company’s simply because the company uses it.

Ownership questions can become important when investment, a sale or changes between founders are being discussed.

Contact Corpinal IP to discuss whether a professional review of your trade mark ownership arrangements would help.

Your customer types your website address. One letter is wrong. They arrive somewhere else.

That is the idea behind typosquatting: using a misspelled version of a brand or domain name to exploit typing mistakes.

Lookalike domains can divert visitors or be used in misleading emails. But a similar name does not automatically establish a right to recover the domain. The rights, evidence and circumstances need assessment.

Concerned about a domain resembling your business name? Contact Corpinal IP to discuss whether we can assist.

Has another business challenged your brand name?

A trade mark complaint can raise difficult questions about your stock, packaging, website and future plans. The wording of the complaint is only part of the picture. The rights, evidence and commercial circumstances also matter.

Contact Corpinal IP to discuss whether we can assist with your dispute and the scope and fees for a professional assessment.

Registered your company name and bought the domain? There is another part of the brand picture to consider.

Company names, domains and trade marks have different roles. A company registration or available domain does not, by itself, confirm that your proposed brand is clear to use or protected as a registered trade mark.

Launching a drinks brand? Before you print the labels, check the name.

A name can look perfect on a bottle or can. But an available company name, domain or social media handle does not establish trade mark clearance.

Before committing to packaging and launch, consider:

• Earlier trade marks: could a similar name already be protected for relevant goods or services?
• Distinctiveness: does your name identify your brand, or simply describe the drink?
• Products and markets: what will you sell, and where do you plan to launch?

These questions deserve attention while changing the name is still manageable.

We’ve published a practical guide for drinks founders covering name searches, trade mark classes and brand protection before launch:

https://corpinalip.co.uk/drinks-brand-assessment-redesign/

Already have a proposed name? The guide also links to our Drinks Brand Pre-Launch Assessment, where you can tell us about your product and plans. We’ll contact you about the appropriate next step. Submitting the form does not provide a clearance opinion; substantive work requires an agreed scope and fees.

🚨 Think trade mark infringement only means selling counterfeit goods?

UK trade mark law can also cover the materials and articles used to create or promote infringing products.

🔹 Infringing goods – Goods or packaging bearing a sign that infringes a registered trade mark.
Example: A fake handbag carrying another company’s registered logo.

🔹 Infringing material – Labels, packaging or advertising material used in an infringing way.
Example: Fake labels bearing a brand’s registered trade mark, ready to be attached to products.

🔹 Infringing articles – Tools or equipment designed to reproduce a protected trade mark and used, or intended to be used, for producing infringing goods or material.
Example: A specially made printing plate used to reproduce a registered logo on counterfeit products.

📌 Trade mark protection can extend beyond the counterfeit product itself—to the materials and tools behind the infringement.

🔹 What is a Certification Mark?

A certification mark shows that goods or services meet certain standards or characteristics certified by the proprietor of the mark.

It can relate to:

✅ Origin
✅ Material
✅ Method of manufacture
✅ Quality
✅ Accuracy
✅ Other characteristics of goods or services

💡 Simple example:
Imagine a mark that certifies that a product is made from 100% organic materials and meets specific quality standards.

When customers see the certification mark, they know the product has been checked and certified against those standards.

📌 Key point: A certification mark is not simply about identifying who provides the goods or services. It indicates that they have been certified against particular standards.

🚨 Trade Mark Infringement: What Can You Do?

If someone uses your registered trade mark without permission, the proprietor can take legal action.

⚖️ Possible remedies include:
• Damages
• Injunctions
• Account of profits
• Other appropriate relief

💡 A registered trade mark gives you enforceable rights.
