There is a hierarchy of people who will inherit your estate if you do not write a will, this is called the law of intestacy. For instance, your unmarried partner will not receive anything without a will (unless assets are jointly owned) and they will go to children first, if there are no children, parents next if they are still alive, if there are no living parents then siblings next. Just think of all the distress this could cause just because a will was never written.

As well as having an up to date Will it is important to have Last Power of Attorney ( LPA) documents. set up.

There are two types of LPA’s – Property & Financial Affairs and Health & Welfare, and Attorneys are appointed (people you really trust) to act on your behalf if you lose your mental capacity.

Once these documents are completed, they needed to be registered with the Office of the Public guardian before they become live legal documents that can then be used.

LPA’s need to be set up when you have the mental capacity to do so.

Often, I find that people put off writing a Will as they are fearful that doing so will bring about their demise. But once it is all completed, they feel relieved and have peace of mind that their assets are going where they want them to. That they have appointed an executor or executor that they trust and that potential problems can be avoided.

I visit my clients in their homes to have a no obligation discussion and if they wish to proceed , take their instructions and return with their documents to ensure that the signing and witnessing is carried out correctly.
