An excellent knowledge-sharing CPD day for our personal injury law team today. The team enjoyed a busy, informative training day, exploring a range of topical issues, from the modification of judicial expenses to the latest developments in National Personal Injury Court procedures as well as sessions on specific injury types, including medical negligence and tripping and slipping cases.

A special thank you to our guest speaker, James Flett of Alex Quinn and Partners (Law Accountants), for sharing his expertise and providing such a valuable update on judicial accounts.

Personal injury compensation claim success: £35,000 damages for local authority waste operative

Our client, a local authority waste operative, required specialist footwear because, as a type 2 diabetic, he was at high risk of developing foot ulcers.

Despite having told his employer this, and his role involving walking around 10 to 12 miles per day, he was provided with inappropriate, ill-fitting footwear. He and his union representative made repeated complaints to management about the adverse effect the inappropriate footwear was having on his foot. He suffered repeated, painful heel ulceration, ultimately necessitating hospital treatment and intravenous antibiotics. He was then absent from work, and his employment was later terminated on ill health grounds.

A claim for damages failed to receive any meaningful response from his employer, so we raised a court action for damages. Both liability and medical causation remained in dispute.

Having obtained supportive liability and medical evidence, we secured an out-of-court settlement of £35,000. Our client was delighted with the successful outcome.
