(NCDR)

One of the main reasons family law diverged away from civil litigation is that, as much as possible, family law should be about the parties involved coming up with amicable solutions. In some areas of family law it is a court requirement that mediation is attempted before a court application can be made, unless an exemption applies.

If things can’t be resolved, the mediator will issue a MIAM certificate which then allows a court application to be made.

NCDR is a generic term used to describe any process aimed at resolving disputes without going to court. Methods of NCDR include mediation, arbitration and early neutral evaluation.

How will the matrimonial assets be divided?

Section 25 of the Matrimonial Causes Act 1973 states that the court must consider 8 factors when making a financial order, alongside the welfare of any children involved which will be paramount.

1️⃣ Income, earning capacity, property and other financial resources

2️⃣ Financial needs and responsibilities

3️⃣ Standard of living before marriage breakdown

4️⃣ Age and marriage duration

5️⃣ Any physical or mental disabilities

6️⃣ Financial and non-financial contributions made to the marriage

7️⃣ Conduct

8️⃣ Any benefit that a party will lose the chance of acquiring

A question that has come up a few times recently :

“Can I take the kids on holiday without the other parent’s permission?”

📝 You must get permission from anyone with parental responsibility before you take the children abroad unless you have a child arrangement order that states that the children live with you. If that’s the case you can take them for up to 28 days without permission.

⚖️ If you can’t obtain permission then an application will need to be made to the court for a specific issue order.

👮‍♂️ If you don’t get the required permission and still try to take the children abroad then you could potentially face criminal proceedings for child abduction.

💬 If you are a parent that can’t get permission from the other parent to take your children abroad or you are a parent worried that your children may be taken abroad without your permission then get in touch and I can assist you with the necessary court applications, preparation and come to your hearing with you if required.
