Registering a Lasting Power of Attorney (LPA)

An LPA can be registered at any time after it has been created.

Before registration:
โœ… Anyone you've named to be notified must be informed
โœ… The Public Guardian will notify both you (the donor) and your attorneys
โœ… Relatives are not notified unless you've specifically listed them

Key points to know:

- Anyone notified has the right to object
- Once registered, an LPA continues indefinitely
- Attorneys can register it even after you've lost capacity

Lasting Powers of Attorney โ€“ How Many People Should You Appoint?

If you become unable to manage your own affairs, you won't be able to oversee the actions of your attorney. That's why it can be wise to appoint more than one person โ€” helping to reduce the risk of abuse of responsibility.

When choosing attorneys, think carefully about:
โœ… How much you trust them to act in your best interests
โœ… How well they manage their own financial affairs
โœ… Whether you can rely on them to use your money to meet your needs

Depending on the complexity of your situation, professional advice is often a good idea before making an LPA.

You can find guidance from the Office of the Public Guardian or contact us directly to speak with one of our Estate Planning Consultants.
