Caution vs Conviction: What’s the Difference?

When it comes to criminal records, the terms caution and conviction are often
misunderstood — but the distinction is crucial. Let’s break it down:

Caution:

- A formal warning given by the police for a minor offence, such as low-level theft
or minor criminal damage.

- It’s not a criminal conviction, but it does go on your criminal record.

- Cautions can show up on an enhanced DBS check, especially if the offence relates to certain sensitive roles (like working with children or vulnerable adults).

Conviction:

- A conviction happens when someone is found guilty of an offence in court.

- This is more serious and will always appear on a standard or enhanced DBS check unless it becomes "spent" under the Rehabilitation of Offenders Act 1974.

- The length of time it takes for a conviction to become spent depends on the
sentence given, not the offence itself.

Why does this matter?

- A caution might affect job opportunities in certain sectors, but it’s less severe
than a conviction.

- A conviction can have broader implications — from employment to travel visas
— so understanding your record is key.

If you're unsure how your record might affect you, or need advice on disclosing criminal
records to employers, we’re here to help.

5 Common Mistakes to Avoid When Buying Your First Home:

- Overlooking additional costs — It’s not just the deposit! Don’t forget about stamp duty, legal fees, surveys, and moving costs. Always plan for these extras.

- Not getting a mortgage agreement in principle — House hunting without knowing how much you can borrow can lead to disappointment. Secure an agreement in principle so you know your budget

- Letting emotions take over — Falling in love with a property can cloud your judgment. Stay practical, stick to your budget, and consider all factors — location, condition, and future resale value.

- Not asking the right questions — Don’t be shy during viewings. Ask why the seller is moving, how long the property has been on the market, and what’s included in the sale.

- Delaying paperwork – Providing inaccurate or incomplete information on your property details, financial situation or identity can lead to delays or even transaction breakdown. Double check all documentation and be transparent with your conveyancer about any relevant details.

Tip: Do your research, ask questions, and don’t rush. Your first home is a big investment — make it a smart one!

At Walters & Plaskitt Solicitors, we’re here to guide you through every step of the process, making your journey to homeownership as smooth as possible.
