A lot of people assume that once the divorce is done, the finances are sorted too.

They're not.

A financial remedy is a separate legal process, it's how the court divides assets, property and pensions between separating couples.

Without it, there is no legally binding financial settlement, no matter how amicable things are.

That means either party could make a financial claim against the other further down the line. Even years later.

The two processes often run alongside each other, but they are not the same thing, and understanding the difference matters.

If you're going through a separation, the idea of a court battle over money and assets can feel overwhelming. The good news is that court isn't always the only option.

A Financial Dispute Resolution hearing, or FDR, is a structured process designed to help couples reach agreement on finances without a full court hearing.

Here's how it works:

โœ… Both parties set out their financial position in full
โœ… A judge or private evaluator reviews the case
โœ… They give an indication of what a court is likely to decide
โœ… That indication gives both sides a basis to negotiate and agree
โœ… Any agreement is then formalised as a court order

It isn't a final decision, but it's often enough to help couples find common ground and move forward without the stress, cost, and delay of a full hearing.

When a couple with young children separates, one of the most difficult questions is what happens to the family home.

A Mesher Order can provide a practical solution, allowing the primary carer and children to remain in the property until a specified point in the future, such as the youngest child turning 18 or finishing full-time education, at which point the property is sold and the proceeds divided.

Prenuptial agreements have a reputation for being unromantic. But in reality, they're one of the most practical and caring things a couple can do before they marry.

A prenup sets out clearly what happens to assets (property, savings, a business, an inheritance) if a marriage breaks down.

It protects both of you, not just the wealthier partner.

And when it's done properly, it removes uncertainty at what is already an incredibly difficult time.

Here's what a good prenuptial agreement should cover:

โœ… Property owned before the marriage
โœ… Savings and investments
โœ… Business interests
โœ… Inheritance, received or expected
โœ… Financial arrangements for children from a previous relationship

One important thing to understand:

๐Ÿ‘‰๐Ÿป a prenup is not automatically legally binding in England and Wales.
