If you're a parent or carer who has been approached by social services concerning childcare proceedings, it's vital to seek legal advice as soon as possible.

When care proceedings are put in place, it is because a local authority believes there is significant risk of emotional or physical harm to a child. Through the care proceedings process, the court must decide whether the risk to the child is large enough that they must be taken into foster care, or housed with another member of their family.

At Daniel Woodman & Co, we specialise in providing clarity and guidance during the care proceedings process. With the assistance of our professional solicitors, we can guide this process to the best possible outcome for all involved.

In simple terms: when someone passes away and leaves a valid will, the person named as the executor in that will must apply for a Grant of Probate before they can legally deal with the estate — such as accessing bank accounts, selling property, or distributing assets to beneficiaries.

In the UK, this document is issued by the HM Courts & Tribunals Service as part of the probate process.

What does it allow the executor to do?

✔ Access bank accounts held solely in the deceased’s name
✔ Sell or transfer property
✔ Pay outstanding debts and taxes
✔ Distribute assets according to the will

Without a Grant of Probate, many financial institutions will not release funds (unless the estate is very small).

Handling Grant of Probate is easier when you've got an experienced solicitor to advise you on the process. At Daniel Woodman solicitors, we offer a free initial consultation, so we can asses your exact needs.

We're here to help - so get in contact today.

When preparing a financial order, both parties must be aware of what a court will take into consideration. All orders are put before a judge for consideration and approval.

Assets such as bank accounts, pensions, property, income and debts are all taken into account when a financial order is agreed, alongside personal circumstances.

It is important to have a solicitor who can advise you on all the relevant factors considered when a financial order is produced - such as marriage length, or whether you have children.

At Daniel Woodman solicitors, our expert team can assist you in managing your matrimonial finances following separation or divorce.

If social services have concerns about a child they can start a process known as a “Public Law Outline” (PLO).

This process is actioned outside of the Court, to allow parents and social services to work together to try and reduce the concerns they have. The aim of the PLO process is to avoid court altogether.

If you would like to discuss the PLO process, or any related matter, get in touch with us today. Our friendly team are always here to help.
