For it to be properly executed, it must be signed in the presence of two independent adult witnesses, who also sign it.

But informal conversations do not replace a valid Will.

When someone dies without one, inheritance is handled under the rules of intestacy.

But choosing the family members is not the only decision.

You also need to decide how they should act.

- Attorneys appointed jointly must make the relevant decisions together.

- Attorneys appointed jointly and severally may be able to act together or independently, depending on how the LPA is prepared.

Each option has practical differences.

Many parents have already talked about who they would trust to care for their children if they were no longer able to.

But a family conversation does not formally record that decision.

A Will can allow parents to name the guardian they would want for children who are still minors.

Without that written choice, the final decision may not happen in the way the family expects.

Choosing a guardian deserves time and an honest conversation with the family member involved.

It is not about expecting something to happen. It is about making an important wish clear.
