π’ New Adults with Incapacity Court Guidance Now in Force π’
A new All-Scotland Practice Note has been introduced, bringing a consistent approach to Adults with Incapacity (AWI) cases across every Scottish Sheriff Court. βοΈ
The new guidance applies to all applications for new guardianship orders and renewals of existing guardianship orders lodged on or after 13th July 2026.
One of the key changes is that prospective guardians will now be required to provide additional information to satisfy the court of their suitability for appointment.
