What does the law mean when it prohibits 'unnecessary suffering'?

When the law says that animal suffering must not be 'unnecessary', it can sound as though animals are strongly protected. ⚖️🐾

⚠️ But there is another side to that rule: if some suffering is prohibited because it is unnecessary, the law may also be accepting a category of suffering that it considers necessary or justified. Different legal systems use different wording, but the recurring question is similar: when can harming an animal be legally justified? 🌐

Is the law asking whether there is a less harmful way to achieve a human purpose? Or does it also ask whether that human purpose should justify harming animals in the first place? And who gets to decide what counts as 'necessary'? ❓️

This distinction matters because a practice can become less harmful without the law ever questioning the practice itself. ❌️ It also matters because ideas of 'necessity' can reflect dominant social norms, while unfamiliar or minority practices receive greater scrutiny.

💬 The question we leave advocates with is deliberately broader: whose interests define 'necessity', and should the human purpose behind animal harm itself have to be justified?

🎓👏 Congratulations to the 22 participants who completed ICARE’s 2026 Constitutional Animal Rights Law Workshop, and thank you to everyone who took part!

Participants joined us from 15+ countries, supported by 19 scholarships. 🌐

🧑‍🏫 Across 7 expert-led sessions on 25 and 26 June 2026, participants explored constitutional animal rights law from global, comparative, theoretical and practical perspectives—from South Africa 🇿🇦 to Ecuador 🇪🇨 to Finland 🇫🇮. In a 90-minute collaborative mini-lab, they also drafted short constitutional clauses to advance and protect animals' interests. ✍️🐾

The immediate results are encouraging. ⭐️ Survey respondents rated their satisfaction, the workshop’s usefulness and their likelihood of recommending it at 4 or 5 out of 5. Across 11 areas, self-ratings increased from an average of 2.77/5 before the workshop to 3.98/5 afterwards. ⚖️

ICARE is two today. 2️⃣

🦉 Two years ago, we embarked on a mission to address a critical need within the animal rights movement: accessible and rigorous animal rights legal resources and training in animal advocacy and animal rights law, grounded in evidence and academic rigour, and bridging the gap between academia and animal advocacy. ⚖️ We also aimed to create stronger connections among the people working to transform the legal status of animals and interconnected issues, rather than working in silos.

Since then, ICARE has:

👨‍🎓 supported more than 250 participants through 6 online courses and workshops;
🌐 reached animal and food systems transition advocates in 100 countries;
📚 published more than 150 free resources;
🧑‍💻 welcomed over 1,000 people to 11 free seminars and lectures;
🎓 awarded more than €15,000 in scholarship support;
💬 connected more than 100 alums through ARVAN and mentee calls;
📖 seen our first open-access e-book on 'Key concepts in Animal Rights Law' downloaded more than 1,000 times; and
✍️ presented our first research findings at several conferences.

We are incredibly proud of what we and the animal advocates we have supported so far have achieved in such a short timespan.

Today, we are launching Advocatalysts, ICARE’s new community of monthly supporters. 💌

Advocatalysts is our way to bring together advocates and catalysts: people who help us empower animal advocates through the knowledge and infrastructure that move animal rights forward. Because we need your catalytic support to empower animal advocates worldwide!

🏛️ Le Sénat a engagé des travaux de contrôle relatifs à la canicule de l’été 2026. Une question ne doit pas rester en marge de cette évaluation : qu’est-il arrivé aux animaux, et pourquoi la réponse publique n’a-t-elle pas permis de les protéger ? 🚨🐾

✍️ Ces travaux doivent tirer les enseignements de la crise et contribuer à préparer la France à un climat plus chaud et à des événements météorologiques extrêmes plus fréquents. Ils doivent donc aussi examiner la manière dont les fortes chaleurs et les incendies survenus au cours du même été ont éprouvé les capacités d’évacuation, de secours et d’accueil des animaux.

ICARE demande que les travaux évaluent :
• le comptage des mortalités animales, directes comme différées ;
• les capacités réelles d’anticipation, d’évacuation, d’accueil et de secours, y compris lorsque des incendies menacent des centres de soins, refuges, élevages ou autres lieux de détention ;
• la continuité des soins et la coordination entre services de l’État, collectivités, services de secours, vétérinaires et associations ;
• le financement des centres de soins, refuges et autres structures mobilisées ;
• la prévention dans les élevages et tous les autres lieux de détention, ainsi que pendant les transports ;
• l’articulation entre adaptation aux chaleurs extrêmes, prévention des risques et transition alimentaire juste.

Les estimations font état de 3 millions de volailles de chair mortes en quelques jours lors de la canicule de fin juin. L214 Ethique et Animaux a depuis documenté l’enfouissement de milliers de poules dans une fosse en Vendée.🐔

🐦️🦌 En juin, plus de 8 750 animaux sauvages ont été admis dans seulement vingt centres de soins. Au plus fort de la crise, 70 % de ces centres ont dû suspendre les nouvelles admissions faute de capacités suffisantes. Les incendies ont encore aggravé cette vulnérabilité.🔥

ICARE demande à être auditionnée aux côtés des centres de soins, services de secours, vétérinaires, associations et autres acteurs directement mobilisés.
