The Marxist theory of law conceives it as a 'superstructure' brought into existence by the private possession of the means of production and the consequent division of society into classes.
In political and legal theory, liberalism views law as an instrument to protect individual liberties, establish universal rights, and regulate state power through democratic consent.
Conversely, neoliberalism redefines law as an economic tool designed to facilitate market efficiency, protect private property, and promote competition over democratic social welfare.

This free UN course on Climate Change and Human Rights explains why climate action must be grounded in human rights principles. Learners will explore how human rights obligations shape climate mitigation, adaptation, loss and damage, climate negotiations, national and regional action, and climate litigation. By the end, participants will better understand how rights-based, participatory climate action can lead to more effective, fair, and sustainable outcomes.
