This was one of the most complex cases we have handled.
The applicant owns two LLCs registered in Minnesota, United States, and applied as an independent contractor of her own companies. The primary challenge arose from the structure of her businesses. One of the LLCs is registered directly under her personal name, which created additional scrutiny during the review process.
Submitting only one LLC was not a viable option, as the income generated from a single entity did not meet the minimum income requirement for the Digital Nomad Visa. As a result, both LLCs had to be included in the application.
On the 19th working day, we received a notification requesting additional documentation.
First, immigration requested proof of ownership of the LLC registered under the applicant’s name. While her name already appeared in the official registration, we strengthened the file by submitting her Single Member Operating Agreement, along with the company’s filing and renewal history. The document was properly apostilled and sworn translated.
Next, the applicant was asked to provide proof of registration as a self-employed worker in her country of origin. This type of registration does not exist in the United States. In response, we submitted her Income Tax Return for Seniors (Form 1040-SR), which was appropriate given that the applicant is a 70-year-old senior citizen.
To further clarify the situation, we also included a detailed explanation letter addressing the differences between U.S. and Spanish regulatory frameworks.
Following the submission of the additional documents, the applicant’s Digital Nomad residency was successfully granted.
