Residency via Real Estate Investment in Egypt
Foreign nationals are entitled to obtain a residency permit in Egypt by investing in real property.
The duration of the residency depends on the investment value, as follows:
1. Residency Tiers (Duration)
One Year Residency (Renewable): Granted upon purchasing a property valued at a minimum of USD 50,000.
Three Years Residency (Renewable): Granted upon purchasing a property valued at a minimum of USD 100,000.
Five Years Residency (Renewable): Granted upon purchasing a property valued at a minimum of USD 200,000.

2. Eligibility Criteria & Legal Requirements
To qualify for the residency permit, the following conditions must be met:
* Official Registration:
The property must be officially registered with the Real Estate Registry (Shahr El-Akari) or belong to a government urban authority (e.g., New Urban Communities Authority).

* Financial Transfer:
The full purchase price must be transferred from abroad to a certified Egyptian bank. An official bank certificate must be issued to prove the foreign currency conversion for the purpose of the property purchase.

* Payment Completion:
The residency application requires proof that the property value has been paid in full (or as per the minimum thresholds mentioned above).

* Family Coverage:
The residency permit extends to the investor’s spouse and minor children.

3. Note on Egyptian Citizenship
Foreigners may also apply for Egyptian Citizenship by purchasing a state-owned or a licensed private developer property with a minimum value of USD 300,000, subject to specific payment protocols set by the Egyptian government.

Please be advised that "Informal Sale Contracts" (Orfi) or "Signature Validation" (Sihhat Tawqia) lawsuits are insufficient for obtaining a long-term residency permit. Only registered deeds or contracts issued by governmental authorities are recognized for this purpose.

The One-Person Company (OPC) is one of the most significant additions introduced by Law No. 4 of 2018, which amended the Law on Joint Stock Companies, Companies Limited by Shares, and Limited Liability Companies (Law No. 159 of 1981).

The following are the details of this company and the eligibility of foreigners to incorporate it:

First: Definition of a One-Person Company

It is a company whose capital is entirely owned by a single person, whether a natural person (individual) or a legal entity (another company). This company model aims to encourage small and medium-sized enterprises (SMEs) by granting the project owner an "independent financial liability."
Liability: Limited to the extent of the company’s capital only. It does not extend to the personal assets of the founder, which is a major advantage compared to a sole proprietorship.
Management: The owner of the capital manages it personally or appoints one or more managers.

Second: Is a Foreigner Entitled to Incorporate it Individually?
Yes, a foreigner (whether an individual or a foreign company) is entitled to incorporate a One-Person Company in Egypt with 100% ownership, subject to certain regulations:
Treatment as a Limited Liability Company (LLC): The OPC is subject to the same rules as Limited Liability Companies regarding foreign ownership restrictions in certain activities.
Prohibited Activities: A One-Person Company (whether founded by an Egyptian or a foreigner) is not permitted to engage in:
Insurance or banking activities.
Saving or receiving funds.
Investing funds on behalf of others.
Capital: The law has defined the minimum capital for an OPC (currently EGP 1,000 following recent amendments to facilitate investment), and it must be paid in full upon incorporation.
Residency: A foreign investor is entitled to obtain an "Investor Residency" upon incorporating this company, in accordance with the regulations of the General Authority for Investment and Free Zones (GAFI).

Does Difference of Religion Prevent Inheritance Under Egyptian Law?

A frequently asked question concerns the inheritance rights of heirs when their religion differs from that of the deceased, Here are the details according to Law No. 77 of 1943 regarding Inheritance:

🚫 The General Rule:
"No Inheritance with Difference of Religion"
Egyptian law explicitly states that a difference of religion is considered a legal impediment to inheritance , This means:
A non-Muslim cannot inherit from a Muslim.
A Muslim cannot inherit from a non-Muslim.
But.. Are There Exceptions or Legal Solutions?
Although "Inheritance" (as a mandatory legal/sharia division) is barred by the difference of religion, Egyptian law provides alternative legal avenues to ensure rights or fulfill obligations, including:
1. Voluntary Wills (Bequeathal):
A person is legally permitted to leave a will (Wasiyya) for someone of a different religion, provided it does not exceed one-third of the total estate. Wills are valid regardless of religious differences because they are viewed as acts of donation and kindness, not mandatory inheritance.
2. Sales Contracts or Gifts (Hiba):
During their lifetime, an individual may transfer ownership of assets to someone of a different religion through a "valid sales contract" or a "gift (Hiba)." As long as this is done while the person is alive and in full mental capacity, the transfer is legally binding and falls outside the rules of inheritance.
The Bottom Line: While a difference of religion closes the door to "Mandatory Inheritance," it does not close the door to "Kindness and Bequests." Egyptian law protects religious principles while providing legal tools to ensure social and familial stability.

إعلام الوراثة هو المستند القانوني الذي يثبت صفة الورثة الشرعيين للمتوفى ونصيب كل منهم وفقًا لأحكام الشريعة الإسلامية أو القانون المدني المعمول به في الدولة ومع ذلك ، قد تظهر خلافات بين الأطراف المعنية تؤدي إلى الطعن في إعلام الوراثة ، سواء بسبب أخطاء في البيانات أو وجود ورثة غير مذكورين أو اعتراضات قانونية أخرى.

مفهوم إعلام الوراثة ؟
إعلام الوراثة هو مستند يصدر من المحكمة المختصة بناءً على طلب أحد الورثة أو ذوي الشأن، بعد تقديم المستندات المطلوبة لإثبات صفة الورثة الشرعيين للمتوفى.
يهدف إعلام الوراثة إلى تحديد من هم الورثة الشرعيون ونصيب كل واحد منهم في التركة، بناءً على قواعد الميراث المحددة في القانون.
أسباب الطعن في إعلام الوراثة ؟
يمكن أن يستند الطعن في إعلام الوراثة إلى عدة أسباب، منها:

١- إغفال أحد الورثة:
إذا لم يتم إدراج أحد الورثة الشرعيين في الإعلام.
٢- إدراج شخص غير مستحق:
في حال تم ذكر شخص ليس له حق في الإرث.
٣- وجود أخطاء في البيانات:
مثل الأخطاء في اسم المتوفى أو بيانات الورثة.
٤- التلاعب أو التزوير:
إذا تم تقديم مستندات مزورة أو غير صحيحة.
٥- وجود وصية مخالفة:
إذا كان هناك وصية قد تؤثر على توزيع الميراث ولم تُؤخذ في الاعتبار.
٦- عدم الاختصاص:
إذا صدر الإعلام من محكمة غير مختصة.

الجهات المختصة بنظر الطعن في إعلام الوراثة ؟
الجهة المختصة بنظر الطعن تختلف حسب نوع الطعن:

- إذا كان الطعن يتعلق بتصحيح خطأ مادي في الإعلام ، يتم تقديم طلب إلى المحكمة التي أصدرته.
- إذا كان الطعن يتعلق بوجود ورثة آخرين أو تزوير، يمكن رفع دعوى قضائية أمام المحكمة المختصة بشؤون الأسرة.
إذا كان الطعن بناءً على أسباب قانونية تتعلق بعدم الاختصاص أو وجود نزاع جوهري ، يتم اللجوء إلى محكمة الاستئناف.

إجراءات الطعن في إعلام الوراثة ؟
تختلف إجراءات الطعن حسب نوع الاعتراض، ولكن هناك خطوات عامة يجب اتباعها:

- تقديم طلب تصحيح أو تعديل إعلام الوراثة :
يتم تقديم طلب تصحيح إلى المحكمة التي أصدرت الإعلام.
يجب أن يحتوي الطلب على الأسباب الداعية للتصحيح والأدلة الداعمة ،
قد تعقد المحكمة جلسة للنظر في الطلب والاستماع إلى الأطراف المعنية.

- رفع دعوى بطلان إعلام الوراثة :
إذا كان الطعن بسبب التزوير أو إدراج ورثة غير شرعيين، يجب رفع دعوى بطلان إعلام الوراثة أمام المحكمة المختصة.
تشمل إجراءات رفع الدعوى تقديم صحيفة دعوى متضمنة الطلبات القانونية والمستندات الداعمة.
يتم إعلان الورثة الآخرين وإعطاؤهم الفرصة للرد.
تنظر المحكمة في الأدلة المقدمة قبل إصدار الحكم.

تقديم استئناف ضد إعلام الوراثة :
إذا صدر إعلام وراثة غير عادل أو به أخطاء قانونية، يمكن تقديم استئناف إلى المحكمة الأعلى.
يجب تقديم الاستئناف خلال المدة القانونية المحددة.
يستند الاستئناف إلى دفوع قانونية ، مثل عدم اختصاص المحكمة أو وجود مستندات جديدة.

المستندات المطلوبة للطعن في إعلام الوراثة ؟
لتقديم طعن في إعلام الوراثة ، يجب توفير المستندات التالية:

صورة رسمية من إعلام الوراثة المطعون فيه.
شهادة وفاة المتوفى.
مستندات تثبت صفة الوريث (مثل شهادات الميلاد أو الزواج).
أي مستندات أخرى تدعم الطعن، مثل الوصايا أو الأحكام القضائية السابقة.
صحيفة الدعوى إذا كان الطعن يتطلب رفع دعوى قضائية.
الآثار القانونية للطعن في إعلام الوراثة ؟
إذا قُبل الطعن، يتم تعديل إعلام الوراثة بإضافة أو حذف الورثة أو تصحيح البيانات.
في حالة ثبوت التزوير، قد يتم إبطال إعلام الوراثة بالكامل وإصدار إعلام جديد.
يمكن أن يؤدي الطعن إلى إعادة توزيع التركة بناءً على التعديلات الجديدة.

المسؤولية القانونية في قضايا الإنتحار:

​في ظل تكرار الحوادث المؤلمة مؤخراً ، يثور التساؤل حول التكييف القانوني لهذه الوقائع في التشريع المصري ، هل يعاقب القانون على الشروع في الانتحار؟ وما هي عقوبة من يدفع غيره لهذا الفعل؟
​1. الشروع في الانتحار
​وفقاً لمبدأ "شخصية العقوبة"، فإن القانون المصري لا يعاقب الشخص الذي يحاول الانتحار ويفشل ، باعتبار أن العقوبة تهدف للإصلاح ، ومن أقدم على هذا الفعل يحتاج إلى علاج نفسي واجتماعي وليس إلى سجن.
​2. التحريض على الانتحار (الجريمة الغائبة)
​هنا تكمن الخطورة؛ فبالرغم من أن المنتحر لا يُعاقب، إلا أن المُحرض قد يقع تحت طائلة القانون في حالات معينة:
​إذا اقترن التحريض بأفعال تشكل جرائم أخرى مثل (الابتزاز الإلكتروني، التهديد، أو القذف والتشهير)، فإن الجاني يُعاقب على هذه الجرائم بموجب قانون العقوبات وقانون مكافحة جرائم تقنية المعلومات.
​هناك مطالبات برلمانية مستمرة لتعديل قانون العقوبات لتجريم "التحريض على الانتحار" بنص صريح ومباشر لسد أي ثغرة قانونية قد يفلت منها المحرضون.
​3. دور جهات التحقيق
​في كل واقعة انتحار، تباشر النيابة العامة التحقيق كـ "واقعة قتل" في البداية، ولا يتم حفظ التحقيق كـ "انتحار" إلا بعد التأكد من:
​انتفاء الشبهة الجنائية تماماً.
​فحص الرسائل والهواتف للتأكد من عدم وجود ضغوط أو تهديدات خارجية دفعت الشخص لإنهاء حياته.

​كلمة أخيرة..
القانون وُجد لحماية الحق في الحياة، ومواجهة الابتزاز الإلكتروني أو الضغوط النفسية المتعمدة التي تؤدي لهذه النتائج هو واجب قانوني وأخلاقي ، إذا تعرضت أو تعرض أي شخص تعرفه لابتزاز، بادر باتخاذ الإجراءات القانونية فوراً عبر مباحث الإنترنت.

Real estate registration in Egypt is governed by a legal framework designed to protect property ownership, which has undergone fundamental updates under the amendments of Law No. 9 of 2022 regarding the Real Estate Registry.
The cases for real estate registration vary according to the legal instrument held by the individual, as follows:

1. Registration Based on a Final Sales Contract (Consensual)
This is the simplest and most common case, occurring when there is a clear chain of title for the property:
Conditions: The existence of a signed sales contract between the seller and the buyer, provided that the property is already registered in the seller's name at the Real Estate Registry.
Procedure: Both parties head to the Registry to sign the final sales contract before the public notary.

2. Registration of Judicial Rulings (Validity and Enforceability Action)
If the seller refuses to go to the Registry with the buyer, the buyer resorts to the judiciary:
Case: Issuance of a final court ruling for the "Validity and Enforceability of the Sales Contract."
Effect: This ruling replaces the seller's signature, allowing the buyer to transfer ownership into their name independently at the Registry based on the judgment.

3. Registration Based on Adverse Possession (Acquisitive Prescription)
The new law allows for the registration of properties for which owners do not hold registered deeds, under two scenarios:
Five Years Possession: If the possessor holds a legal instrument (customary/unofficial contract) and has maintained quiet and stable possession for 5 years in good faith.
Fifteen Years Possession: If there is no legal instrument, but the person has maintained open, quiet, and continuous possession of the property for 15 years with the intent of ownership. This is proven through all methods of evidence (utility bills, witness testimony, site inspections).

4. Registration of Inheritance Rights
The transfer of property from the deceased to the heirs is a material fact that requires registration so that the heirs may legally dispose of the property later:
Procedure: A "Certificate of Heirship" (Ealam Weratha) is submitted along with the decedent’s ownership documents to register the inheritance right in the Real Estate or Land Registry, thereby registering each heir's share in their name.
