⚠️ Can you lose your Canadian Permanent Residence status decades after being recognized as a protected person?
A recent Federal Court decision (Slepcsik v. Canada, 2025 FC 1840) proves that you can.

The Case Breakdown:
🔹️1997–1999: Roman Slepcsik fled persecution against Roma in the Czech Republic, was granted refugee status, and became a Canadian Permanent Resident (PR).
🔹️The Action: Over the following years, he obtained a Czech passport and made trips back to his home country for family reasons (including caring for a sick relative).
🔹️The Legal Trap: Under Section 108 of the Immigration and Refugee Protection Act (IRPA), travelling on your home country's passport or returning to your home country can trigger "cessation" (re-availment of national protection).
🔹️The Fallout: Under changes made to Canadian law in 2012 (IRPA s. 46(1)(c.1)), if your refugee status is ceased, your Permanent Residence status is automatically stripped.

The Federal Court dismissed his constitutional Charter challenge, confirming that PR status alone does not shield a former refugee from losing their status due to cessation. Because the Federal Court certified serious questions of general importance, the decision can be appealed to the Federal Court of Appeal.

💡 The Key Takeaway:Permanent Residence does not extinguish underlying refugee status obligations. If you obtained PR through refugee protection, travelling back to your country of origin—even briefly or on a home-country passport—can jeopardize your entire life in Canada. Always seek specialized legal advice before travelling.

Your representative's mistake can still be your problem

The Federal Court has dealt many times with applicants who discovered, after a refusal, that an agent had altered documents, inflated experience or answered questions they never saw. The general position is uncomfortable: an applicant remains responsible for the contents of their own application.

There are cases where extraordinary agent misconduct has been recognised, but the applicant has usually had to show diligence of their own — that they reviewed what they could, that they raised the issue promptly, that they didn't simply hand over a passport and stop asking.

What this means for you: verify your representative's licence, insist on seeing the final package, and keep a copy.
