Most people don't know it exists until they're already in a claim.

Atlantic Canada has a minor injury cap. It's a government-set limit on part of what you can be paid for pain and suffering if your injury is classified as "minor."

Sprains. Strains. Most whiplash. Things that sometimes get classified as minor, even when they take months to heal or affect your work and sleep.

For 2026, the cap is $10,862 in NS, $9,926.59 in NB, and $9,659 in PEI.

The catch is in the definition. Whether an injury is classified as "minor" depends on how it actually affects your life, your job, and your daily activities, not just a simple checklist.

Important to know: the cap only applies to pain and suffering. Other parts of your claim, like loss of income and out-of-pocket expenses, aren't capped.

If you've been in an accident in NB, NS, or PEI and an adjuster has used the word "minor", talk to someone before you sign anything.

In Atlantic Canada, "contributory negligence" means your compensation is adjusted based on your share of responsibility, not completely eliminated. Don't let insurers push you into accepting more blame than is accurate, it directly reduces what you are entitled to!
