After five years of hard work and four different levels of Court, this is a big win for our office to finish off 2018! The Supreme Court of Canada ruled in a 7-2 decision that the Victim Fine Surcharge regime infringes s. 12 of the Charter and is not saved by s. 1. It is invalidated with immediate effect. Major historical event in criminal justice!

Après cinq ans de travail ardu et quatre niveaux de Cour différents, c'est une grande victoire pour notre bureau pour terminer l'année 2018! La Cour suprême du Canada a statué dans une décision 7-2 que le régime législatif de la suramende compensatoire porte atteinte à l'art. 12 de la Charte et n'est pas sauvegardé par l'art. 1. Due to $26 million deficit, Legal Aid Ontario will only issue legal aid certificates to impoverished people facing a "substantial likelihood" of incarceration.

In order to deal with a $26 million deficit, Legal Aid Ontario will no longer be providing certificates, which cover the cost of a private lawyer, to thousands of impoverished people facing criminal charges.
