This is not my refusal.

But I’ve seen a few in the past few months that were completely avoidable.

Sometimes the applicant submitted to the wrong program; missed documents; misunderstood the policy.

Immigration rules are complex, and there’s a lot of noise online.

I’ve spent most of the past 20 years in immigration, yet even today, I consulted an RCIC colleague to confirm that I’m understanding the instructions correctly.

That’s not a weakness, it’s good practice.

Even immigration officers in the field consult HQ when they need clarity.

How much more important is it for someone without the experience and formal training?

Back to refusals.

Professional fees can be costly, but a refusal can cost far more:

loss of status, loss of income, more fees, family separation, potential removal, even refusal of a related permanent residence application.

I often post about offences under the Immigration and Refugee Protection Act (IRPA) because many people seem to be unaware that certain actions can constitute an offence.

Someone has even advised me, in good faith, to add information to a secure document.

Offences relating to documents include:
⚠️ Altering a document after it has been issued by the issuing authority (such as adding information).
⚠️ Producing a document when you are not the issuing authority.

Conviction can result to imprisonment of up to 14 years.

Conviction for a crime in Canada can make a permanent resident or foreign national inadmissible to Canada🇨🇦.

The 12-business-day processing time was a pleasant surprise, thanks be to God. 🙏

It is tempting to take credit for the speed, but it may simply mean that PGWPs were assigned faster processing.

"We are impotent." I responded to a former CBSA colleague on the topic of immigration fraud.

I repeated it - twice - in response to his shock, in case he hadn’t understood my accent.

A reminder that language differences can occasionally lead to unintended meanings.

On a serious note, I’ve had the pleasure of meeting many highly educated and professional RCICs. As in any profession, there are a few bad apples, but it is encouraging to see CICC making progress in addressing those who fall short of professional standards.

I once told a CBSA Investigator that many immigrants do not know Canadian immigration law, and that newcomers often turn to each other for help.

⚠️A word of caution: advising applicants to misrepresent information in an immigration application is an offence under IRPA that can carry a fine of up to $100,000 and/or up to 5 years' imprisonment.

When I left my previous job, I told my former manager, “I want to help people.”

I cannot help everyone. And I have spent too many years working on mitigation of immigration fraud to make promises to those who have little chance of success.

But there are those who are eligible, yet fail, or are at risk of failing, because they lack knowledge of the rules and processes.

IRPA s.91: It is ILLEGAL to accept payment in exchange for providing immigration advice or services if you are not an authorized paid representative.

You may think you are helping, especially if you charge a small amount, but you could be doing more harm than good.

IRPA s.40: Applicants who fail to disclose that they PAID an unauthorized representative ("ghost consultant”) to prepare or assist with their application may be found inadmissible for misrepresentation.

⚠️Misrepresentation can result in refusal and a five-year ban from Canada.🇨🇦

Why is there a four-year gap in your education?

The client explained that he had to stop school due to financial constraints.

He eventually finished university, worked as a foreign worker, and saved enough to bring his family to Canada, where he completed his postgraduate studies.

He is one of many like me who worked hard and persevered to build a better life.

And they're a wonderful, honest, and respectful family who are active in their church community.

I’m proud to be part of their journey, and I hope their PR process goes smoothly.🙏

IRCC has a dedicated mailbox where immigration consultants can raise policy or process questions that are NOT tied to a specific case. I learned about it after becoming a consultant.

A client raised a concern about a supposed refusal because their Philippine Police Clearance had no thumbprint, while IRCC's website stated the document "must have a thumbprint".

Since genuine Philippine PCs issued to Filipinos abroad may not include a thumbprint, I raised the issue with the appropriate authorities.

Grateful for the guidance I received. IRCC has since updated the website instructions.
