বাংলাদেশ ব্যাংকের সিআইবি সার্কুলার (২৩ জুলাই ২০২৬) – সংক্ষিপ্ত সারাংশ
বাংলাদেশ ব্যাংক সিআইবি (Credit Information Bureau) সংক্রান্ত নতুন নির্দেশনা জারি করেছে। এই নির্দেশনার মূল উদ্দেশ্য হলো সিআইবি রিপোর্ট সার্ভিস চার্জের হিসাব ও আদায় প্রক্রিয়ায় স্বচ্ছতা নিশ্চিত করা এবং অনলাইন সিস্টেমে মাসিক তথ্য যথাসময়ে আপলোড নিশ্চিত করা।
মূল বিষয়সমূহ: ✅ প্রতি মাসের তথ্য পরবর্তী মাসের ১০ তারিখের মধ্যে সিআইবি সিস্টেমে আপলোড করতে হবে।
✅ সিআইবি সার্ভিস চার্জ মওকুফ বা অব্যাহতি পেতে হলে নির্ধারিত সময়ের মধ্যে আবেদন করতে হবে।
✅ চার্জ সংক্রান্ত কোনো আপত্তি থাকলে নির্ধারিত সময়সীমার মধ্যে সিআইবি-তে আবেদন করতে হবে।
✅ নির্ধারিত সময়ে আবেদন না করলে বা অসম্পূর্ণ আবেদন করলে তা বিবেচিত হবে না।
✅ ব্যাংক ও আর্থিক প্রতিষ্ঠানসমূহকে তথ্য হালনাগাদ ও সঠিকভাবে রিপোর্টিং নিশ্চিত করার নির্দেশ দেওয়া হয়েছে।
সারকথা: সিআইবি রিপোর্টিং ও সার্ভিস চার্জ ব্যবস্থাপনায় শৃঙ্খলা, স্বচ্ছতা এবং সময়মতো তথ্য প্রদান নিশ্চিত করাই এই সার্কুলারের মূল লক্ষ্য।

Farewell to Mr. Torikul, Assistant our office

Mr. Torikul joined Barrister Asad & Jurists in 2023 and rendered his services with sincerity, dedication, and professionalism throughout his tenure. His last working day with the chamber was 20 May 2026.
On the occasion of his farewell, both junior and senior colleagues of the chamber were present to convey their appreciation, heartfelt gratitude, and best wishes for his future endeavors.
We sincerely wish Mr. Torikul every success, prosperity, and happiness in all aspects of his life and career ahead.

আদালতে না গিয়েও বিচার পাওয়া যায়!

জানেন কি আরবিট্রেশন কী?

আপনি কি কখনো ব্যবসায়িক বিরোধে পড়েছেন?

২. বিরোধ হলে নোটিশ পাঠানো হয়
৩. নিরপেক্ষ আরবিট্রেটর নিয়োগ হয়
৪. উভয় পক্ষ তাদের কথা বলে
৫. আরবিট্রেটর রায় দেন
৬. রায় না মানলে আদালতের মাধ্যমে কার্যকর করা যায়

Case Update:

Regarding travel ban in Artha Rin Suit under section 57

Writ Petition: 8149 of 2025

🔹 Key Highlights

Bank Asia PLC as petitioner filed Artha Rin Suit No. 2029 of 2024 seeking recovery of BDT 115 crore from a borrower company and its directors/guarantors.

The Bank requested a travel ban on defendants fearing they might leave the country to evade repayment.

Learned Artha Rin Adalat rejected their prayer, citing sufficient mortgaged properties to secure the loan.

The Bank challenged this decision before the High Court Division under Article 102 of the Constitution.

🔹 Hon'ble High Court’s Observations:

Article 36 of the Constitution guarantees freedom of movement, including the right to leave the country.

📝 Restrictions on this right must be:

Authorized by law, and
Reasonable and in public interest.

Financial liability alone or pending litigation does not justify a travel ban.

Section 27kha of the Bank Companies Act, 2023 regulates the declaration of “willful defaulters” only Bangladesh Bank has authority to notify restrictions.

The Court relied on 74 DLR (AD) 1:

No restriction can override constitutional rights. Restrictions must have a direct, lawful purpose and cannot be arbitrary.

🔹 Final Decision:

Hon'ble High Court Division upheld the Artha Rin Adalat’s rejection of the travel ban and also given some observations like Courts cannot impose travel restrictions without clear statutory authority, even in high-value loan cases. Fundamental rights, including freedom to travel, are protected under the Constitution.
Banks cannot bypass the law or courts cannot arbitrarily restrict movement, even if large loans are unpaid.
