We are pleased to share our latest legal update on a significant order of the Company Bench of the High Court Division concerning ongoing BGMEA Arbitration proceedings involving a New York-based apparel sourcing and supply chain management corporation.

The Court stayed the proceedings under Section 20 of the Arbitration Act, 2001, following a challenge to the jurisdiction of the BGMEA Arbitration Tribunal in the absence of a written arbitration agreement.

The High Court also summoned the Secretary General of BGMEA to explain a demand letter sent to the foreign buyer and whether BGMEA has the authority to compel non-consenting parties to arbitration.

We are pleased to share our latest legal update on a significant judgment concerning the right of the two sons and two daughters of Kazi Shamsul Haque, the 92-year-old founder of Lakeshore Hotel, to remain in contact with and care for their father.

Allowing the habeas corpus petition, the High Court Division held that the petitioners are entitled to visit their father, maintain communication with him, and provide him with care and attention. The Court also directed that no person may obstruct or interfere with such visits, communication or care, with necessary assistance to be provided by the relevant police authorities if required.

The full judgment was published on 30 July 2026, following the short judgment delivered on 18 February 2026.

On 16 August 2026, Mahbub & Company's Cross-Border Disputes Department held an insightful session on "Construction Contract and Power Purchase Agreements (PPA)", led by Saqeb Mahbub, Partner at Mahbub & Company. The session explored how large-scale construction contracts and PPAs operate in Bangladesh along with the role and implementation of FIDIC standards. Discussions also covered the General Conditions of Contract (GCC), Particular Conditions of Contract (PCC), variations and adjustments in contract and employer's and contractor's claim mechanism.

We are pleased to share our latest legal update on a significant order of the Company Bench of the High Court Division concerning an arbitral award issued by the BGMEA Arbitration Tribunal against a New York-based apparel sourcing and supply chain management corporation.

The update discusses the Courtโ€™s decision to stay the operation of the arbitral award following an application filed under Section 42 of the Arbitration Act, 2001. The petitioner challenged the award as ex facie illegal and passed without jurisdiction, arguing, among other grounds, that there was no written arbitration agreement between the parties as required under Section 9 of the Arbitration Act, 2001 and the BGMEA Arbitration Rules, 2016.

The petitioner further contended that it was neither a party to the underlying export contracts nor a beneficiary of the relevant letters of credit. The application also raised concerns regarding the delayed service of the arbitral award.

The order highlights important issues concerning the validity of arbitration agreements, jurisdiction and procedural compliance in arbitral proceedings involving international commercial parties.

We are pleased to share our latest legal update on a significant decision of the Commercial Court concerning the interplay between the Artha Rin Adalat Ain, 2003 and the Arbitration Act, 2001.

The update discusses the Courtโ€™s decision to allow an Arbitration Miscellaneous Case filed by Mahbub & Company on behalf of a renewable energy power producer, and to appoint an arbitrator under Section 12 of the Arbitration Act, 2001, despite the pendency of recovery proceedings before the Artha Rin Adalat.

The decision reinforces the pro-arbitration approach of the Bangladeshi courts. It recognises that the pendency of recovery proceedings does not, by itself, prevent parties from pursuing arbitration where a valid arbitration agreement exists. It also affirms the independent and enforceable nature of an arbitration clause and the importance of giving effect to the partiesโ€™ agreed dispute resolution mechanism.
