A fascinating (and often overlooked) risk in the $3.5+ trillion intergenerational wealth transfer underway in Australia: what happens when the wealth… can’t be accessed?

I recently had the opportunity to share my legal commentary with Jessica Penny in the Australian Financial Review on a growing issue, lost crypto keys and the legal blind spots they expose. 🔐

As digital assets become more embedded in portfolios, they’re also challenging some of the most fundamental assumptions in estate planning.

Unlike traditional assets, crypto doesn’t recognise:
• executors
• probate processes
• or even death itself

Access is everything and without the right planning, that wealth may be permanently lost. 🔒

This raises important questions for advisers, lawyers and families:
• Are wills and estate plans keeping pace with digital assets?
• Who actually has access to private keys?
• How do we balance security with succession?

The reality is that technology is outpacing the law, and intergenerational wealth transfer is no longer just about tax structures or family dynamics it’s about access, custody, and digital governance.

For anyone working in private wealth, this is a conversation we need to be having now not after the keys are gone.

Still feeling incredibly grateful for the opportunity to speak at the Disrupting Tradition Conference on Elder Law.

It was truly an honour to be invited to share my insights on the protective jurisdiction—an area of law that carries such profound responsibility and impact. Being in a room filled with passionate professionals committed to challenging norms and improving outcomes for vulnerable individuals was both inspiring and energising.

Conversations like these matter. They push us to reflect, to evolve, and to continue advocating for systems that protect dignity, autonomy, and justice.
