On a more serious note, domestic violence is currently a very political topic, and whilst victims of domestic violence deserve support, I am also coming across cases where DV applications are being used to gain an advantage in other court proceedings such as family court matters.

We are willing to help victims and respondents alike to ensure that the process is fair and that those deserving of protection get it. But we are also willing to help in cases where these applications are being used in circumstances where they may not be justified.

The best option is to simply make an appointment and ask our advice.

Family Court Ruling from the Federal Circuit and Family Court of Australia

A seven year old boy was at the centre of a courtroom drama yesterday when he challenged a court ruling over who should have custody of him.

The boy has a history of being beaten by his parents and the judge initially awarded custody to his aunt, in keeping with the child custody law and regulations requiring that family unity be maintained to the degree possible.

The boy surprised the court when he proclaimed that his aunt beat him more than his parents and he adamantly refused to live with her. When the judge suggested that he live with his grandparents, the boy cried out that they also beat him.

After considering the remainder of the immediate family and learning that domestic violence was apparently a way of life among them, the judge took the unprecedented step of allowing the boy to propose who should have custody of him.

After two recesses to check legal references and confer with child welfare officials, the judge granted temporary custody to the New South Wales state of origin team, whom according to all the leading experts, are not capable of beating anyone.

Mobile phones and driving are now being aggressively targeted in the form of camera detected offences. I have had a number of clients that have received these in circumstances where the footage is far from clear and there is real doubt about whether the device shown is a telephone. I would strongly suggest you get legal advice before paying these infringement notices should you receive one.

Private Prosecution - As a victim of crime, it is not necessarily out of your hands.

Sometimes, victims of crime do not receive the response that they may wish from the Queensland Police. If for example you are a victim of crime and believe that you have not received justice, you do have options. This includes a private prosecution wherein the victim instead of the police commences and takes control of the proceedings. As someone who was a police prosecutor for many years, backed by years of investigative experience, I am in the rare position where I can provide insight and legal advice on both sides.

I thought this year I would get in early. 2021 has been interesting and challenging for many with some challenges for sure. As we wind up for the year to spend time with friends and family. I have been fielding plenty of inquiries about the fees charged for matters in the Magistrate's Court. I've added a services section with indicative pricing for common matters in the Magistrate's Court. I want my clients to know what they're looking at up front. Clearly some are more complex than others, but the services listed should give you an accurate indication as to what you're looking at in most cases.

Prices are for Solicitor only. Barrister's fees are extra.
