We appeared at Sunday Bail Court this weekend advocating on a release application for our client charged with Supplying a prohibited drug and dealing with proceeds of crime.

After careful crafted proposed bail conditions to mitigate the unacceptable risk test in the Bail Act, our client was granted bail to await his trial in the community

We were up in Cessnock last week, advocating in a summary defended trial for a vulnerable client in custody. One of the charges he faced was a charge of stalk or intimidation, which carries a maximum 5-year imprisonment and/or a fine of $5,500.00. After a whole day hearing and cross examination of both the police and the alleged victim, we were able to secure a verdict of not guilty! The Court found that whilst my client words were intimidating it could not be satisfied beyond a reasonable doubt that he intended to intimidate, meaning he did not intend to cause the alleged victim to fear physical or mental harm. A great result for our client!

This week we represented a gentleman charged with Affray, which carries a maximum 10 years' imprisonment. The charge was concerning an assault by two men on a 12-year-old boy. After careful submissions we were able to secure a non-conviction sentence for our client. Meaning our client will have no criminal record for this offence. Whilst a serious offence there were mitigating and extenuating circumstances which when considering in the context of the offence meant that our client, whilst still criminally responsible for committing the offence it was a case where the Court could use its discretion to not record a conviction.
